2 Federal Aviation Administration Office of Commercial Space Transportation May 10, EASA update on regulating suborbital vehicles in Europe European Aviation Safety Agency Report – European Aviation Safety Plan [undated; Fall 2011?] Excerpt from page 49: EME1.6 Suborbital planes regulation. Regulate sub-orbital planes. EASA “Pre-RIA and ToR drafted, submittal to SSCC put on hold due to a new directive from the Commissioner’s Cabinet to investigate a lighter process, similar to FAA-AST “Launch Licensing”. Sub-orbital Working Group (SoWG) is subsequently currently drafting possible amendments to the BR to accommodate for this lighter approach, however 3 European stakeholders confirmed their demand for full certification (EADS, Booster, REL-Skylon). To meet their application times and allow them to design according to the rules, task MDM.098 should start during the third quarter of 2011 and should end in 2014.” [Notes: Pre-RIA-- Preliminary Regulatory Impact Assessment SSCC -- The Safety Standards Consultative Committee BR-- Basic Regulation. ] –Source: EASA said in April 2012 this information is obsolete

3 Federal Aviation Administration Office of Commercial Space Transportation May 10, UN COPUOS Long Term Sustainability of Outer Space Activities The United Nations Committee on the Peaceful Uses of Outer Space (UN COPUOS) established a study effort on the Long Term Sustainability of Outer Space Activities. –Industry invited to participate through U.S. State Department The overall goal of the expert groups is to put forth best practices and guidelines for the international community to use. The Working Groups are: A. Expert group on sustainable space utilization supporting sustainable development on Earth B. Expert group on space debris, space operations and tools to support collaborative space situational awareness C. Expert group on space weather D. Expert group on regulatory regimes and guidance for actors in the space arena COMSTAC nominated two people: –Rachel Yates of Holland & Hart LLP for Group D –Chris Kunstadter of XL Insurance for Group B First formal meetings were in February 2012 in Vienna at UN COPUOS Scientific and Technical Subcommittee Next meetings: June 6-15 in Vienna and UN COPUOS –Informal meetings planned in October 2012 in Naples, Italy at IAC –2013 meetings in February and June at UN COPUOS with completion in June 2014

4 Federal Aviation Administration Office of Commercial Space Transportation May 10, UN Expert Group Group B on Debris First formal meeting was in February 2012 on the margins of UN COPUOS –The group formally adopted a method of work and reviewed inputs received to date from UN COPUOS member states, intergovernmental organizations and national nongovernmental organizations. Expert Group B will develop a consolidated set of current practices and operating procedures, technical standards and policies to strengthen measures to mitigate orbital debris; to promote safe and responsible operations in space; and to improve information collection and sharing for space object collision avoidance, debris monitoring, and general situational awareness. Expert Group B will provide the LTSSA Working Group with a set of voluntary “best practice guidelines” focused on practical and prudent measures that could be implemented in a timely manner by States, either individually or collectively, and by governmental and private sector spacecraft and launch vehicle operators and manufacturers. A U.S. Government draft of best practices was distributed by State Department to industry with comments due May 11, 2012.
