Case Study Kim Siebott Lynn Yip

Key Terms Drug Test: a test administered to determine the presence of drugs in someone’s body. Drug Policy: the policy written by employers to clarify that drug use is unacceptable in the work place. State Law: laws written by state legislatures that regulate a variety of things.

Summary An employee was administered a drug test by his employer and failed. As a result, the employee was fired and then sued the company for violating Iowa’s drug law in giving employees written notice for termination.

Verdict He was due attorney fees and court costs, but not punitive damages, back pay, or reinstatement because he failed the drug test and the employer violated the policy of notification.
