INAC’s Role in the Doris North Review Responsibilities, mandate and obligations stem from the following legislation: DIAND Act Nunavut Land Claims Agreement Territorial Lands Act and Regulations Nunavut Water & Nunavut Surface Rights Tribunal Act Canadian Environmental Assessment Act Mine Site Reclamation Policy for Nunavut

INAC’s Role in the Doris North Review Project is on Inuit Owned Lands –except the jetty which is on Crown land INAC’s review is focused on: –water quality and quantity; –surface and permafrost disturbance; –waste rock management; –monitoring; and –abandonment and reclamation.

Water Quality and Quantity

Water Quality – Discharge Criteria Miramar proposes to: Meet CCME Water Quality Guidelines downstream of Doris Lake Meet Metal Mining Effluent Regulations discharge limits

Water Quality – Discharge Criteria Comments INAC recommends that the water quality model be rerun and recalibrated on a routine basis to confirm assumptions.

Land Surface and Permafrost Stability

Surface / Permafrost Disturbance Stability and efficiency of the Tail Lake North and South Dams Tail Lake Shoreline Protection Measures Management of Demolition Landfill Facility Stability of Underground Mine Opening Upon Mine Closure

Landfarm Facility Miramar proposes to treat contaminated soils through land farming INAC recommends the facility be Maintained and monitored to ensure best performance; and Managed by a person with experience in bioremediation.

Waste Rock Management

Mine waste rock will be returned underground INAC recommends waste rock be: –Placed in temporary waste rock depending on type of rock; –Tracked as placed underground; and –Any remaining waste rock not yet returned underground after two years should be characterized to determine risk.

Monitoring

Continue monitoring water level, quality and quantity Update site water balance model with monitoring data Continue climate station Annual reporting of geochemical and volumes Monitor rock and permafrost temperatures

Abandonment & Reclamation

INAC’s standard of reclamation is based on meeting the objective of: “returning mine sites and affected areas to viable and, wherever practical, self-sustaining ecosystems that are compatible with a healthy environment and human activities.”

Abandonment & Reclamation A&R Plan is acceptable. Periodic updates are recommended Total reclamation and post-closure monitoring is estimated at $12.3M INAC recommends a review of the A&R Plan and security amounts on a regular basis to accommodate changing circumstances

Segregation of Land and Water Security Total security = total outstanding liability for land and water Security is required for KIA and Crown land tenures and NWB water licence INAC recommends that security be split into water and land components with review triggers built into all permits and leases

Conclusions INAC has confidence in Miramar Hope Bay Ltd.’s planned operation and management of the Doris North project Our recommendations are provided to address outstanding issues We thank the NWB for considering our intervention and presentation and look forward to a continued and productive working relationship with all parties
