4Page - The United States Environmental Protection Agency (EPA) an agency of the U.S. Federal government, created on December 2, 1970.

5Page - The California Air Resources Board pre-dates the United States EPA by several years. The Air Resources Board (ARB) was formed in 1967 and essentially answers to the Governor of California.

6Page - Since the ARB existed in California as a governing body prior to the introduction of the US EPA, the Federal Government needed to clarify jurisdiction.

7Page - “The State of California has the right to adopt its own emission regulations” California is the only state with the authority to develop its own emission regulations. Other states have a choice to either implement the Federal emission standards, or else to adopt California requirements.

8Page - The New York State Department of Environmental Conservation (NYSDEC) was founded in The agency enforces the state's environmental laws and regulations including all aspects of air quality.

9Page brought about some changes affecting how we sell catalytic converters in the State of New York

10Page - Simply stated, C.A.R.B. law prohibits the sale, advertisement for sale or installation of any aftermarket catalytic converter in the State of California. By adopting California law, the same is now true in New York.

11Page - To legally sell an aftermarket catalyst in these states, each converter must be exempted from this law on an application-by-application basis. That is what C.A.R.B. compliancy means.

12Page - This exemption is granted by the California Air Resources Board through the execution of an executive order.

19Page - In California, every vehicle regardless of year or emission certification requires a C.A.R.B. compliant aftermarket catalytic converter.

21Page - In New York (1) All and 1996 or newer vehicles built to California (or 50 State) emissions require a C.A.R.B. compliant aftermarket catalytic converter.

22Page - (2) EPA compliant catalytic converters may be installed on any vehicle that was built to “EPA” or “Federal” emissions.

23Page - Please be aware In an effort to protect all involved It is Autopart Inernational’s policy that any non-C.A.R.B. converter sold in New York State will require the approval of Corporate Management.

24Page - (3) The 1995 model year was exempted from this law by the NYSDEC because of a successful legal action taken against the State of New York by vehicle manufacturers in the early 1990s.

On May 28, 1992 New York adopted C.A.R.B. compliancy for all new vehicles being sold in the State. Vehicle manufactures protested the ruling because it did not provide them with the required 2 year lead time necessary to bring their upcoming 1995 model year vehicles into compliance. 25Page -

26Page - OBD – I 1993 & 1994 Verify whether the vehicle was manufactured to Federal or California standards. If it was built to Federal standards, either an EPA compliant or a C.A.R.B. compliant aftermarket catalytic converter may be installed. What information is required?

27Page - If it was built to California standards, only a C.A.R.B. compliant aftermarket catalytic converter may be installed.

28Page - OBD - II Just as with OBD-I, all OBD II vehicles (with the exception of the 1995 model year), manufactured to California emission standards require a C.A.R.B. compliant catalytic converter to be installed.

29Page - For OBD-II however, 2 more pieces of information need to be obtained before an aftermarket catalytic converter can be selected.

30Page - The “Engine Family” or “Test Group” number, and the “certification level” from the VECI label (Vehicle Emission Control Information Label). This information must match exactly for the converter to be legally sold or installed in New York State.

31Page - For OBD-I, (or Pre OBD-II) vehicles as we just discussed, Engine family and Certification levels are not required. (This will be further illustrated with VECI examples)

32Page - Each OBD-II vehicle’s engine family or test group is a distinctly different vehicle. Under C.A.R.B. Regulations

35Page - Be careful! ALL VECI Labels are located in the engine bay area. Often an installer will go the driver’s door and see a Safety Standard label like this one stating “FEDERAL” and mistakenly think this is referring to the vehicle’s emission certification: This is NOT a VECI Label

36Page - OBD-II engine family data cannot be decoded from the VIN. If the VECI label is missing, the only way to obtain the information is to order a new label from the dealer.

37Page - Obtain year / make / model / engine size and whether the vehicle was built to California or Federal emissions. If the vehicle is OBD-II compliant, obtain engine family and emission level from the VECI Label. Use the proper catalog to look up the application. All information including engine family must match exactly. So, the correct procedure for selling an aftermarket catalytic converter in New York is:

40Page - Don’t Assume! You may find only one engine family listed in the C.A.R.B. website, or in your catalog … But there may be more!

46Page - Selling or installing a converter on a California emission vehicle with non-matching information is a violation of New York State law and is enforceable by the NYSDEC.

DEC currently has nearly 1,400 C.A.R.B. compliant direct fit catalytic converters in our catalog, ready to ship today, and we are adding more every week. That represents about 13,000 applications! If there’s an EO available, DEC builds the direct fit cat.

50Page - DEC Catalytic Converters will not appear on the ARB website because we are not a canner.

51Page - The canner is the company that builds the universal used to build a direct fit converter. Executive Orders are issued only to canners.

52Page - What makes DEC converters legal, and C.A.R.B. compliant is a document called a Cross-Marketing Agreement.

53Page - This is a legal arrangement between DEC, a particular canner and C.A.R.B. Under these agreements, DEC is permitted to use various canners’ universals, under the same strict guidelines set forth by the Air Resources Board, to build C.A.R.B. compliant direct fit catalytic converters.

54Page - That puts DEC in the very unique position of having the most C.A.R.B. compliant SKUs in the industry because we can build with ALL canners’ executive orders, where-as the canning companies only build with their own.
