Staff Analysis  The BZA approved two height variances on this property in The first variance allowed up to 99 feet for a hotel. The second variance allowed height up to 68 feet for a retail building.  The BCC approved variances for heights ranging from 80 to 99 feet within the vicinity along International Drive and a taller structure has been approved a few blocks away at the Orlando International Hotel PD- Orlando Eye (450’).  Limited land area requires increased height to add parking.

BZA Findings  Request is consistent with the development trend of the area  Request is similar to other height variances granted in the area  Request met the spirit and intent of the variance criteria

BZA Recommendation  Approved the variance request in that the BZA made a finding that the requirements of Orange County Code, Section 30-43(3) have been met. Approval is subject to 5 conditions  Unanimous vote (4-0)

BZA Conditions 1.Development in accordance with the site plan dated “Received June 13, 2014” and all other applicable regulations. Any deviations, changes or modifications to the plan are subject to the Zoning Manager’s approval. The Zoning Manager may require the changes be reviewed by the Board of Zoning Adjustment (BZA) for administrative approval or to determine if the applicant’s changes require another BZA public hearing. 2.Pursuant to Section , Florida Statutes, issuance of this development permit by the County does not in any way create any rights on the part of the applicant to obtain a permit from a state or federal agency and does not create any liability on the part of the County for issuance of the permit if the applicant fails to obtain requisite approvals or fulfill the obligations imposed by a state or federal agency or undertakes actions that result in a violation of state or federal law. Pursuant to Section , the applicant shall obtain all other applicable state or federal permits before commencement of development.

BZA Conditions 3.Signage for the parking garage and associated uses shall comply with Ch The height limit shall be 111 feet at the highest point and shall have no ancillary equipment above that height. 5.Construction plans shall be submitted within 3 years of Orange County approval or the approval becomes null and void.
