WHAT IS COPYRIGHT? Copyright protects original works of authorship-whether published or unpublished. Copyright grants the author of the work the legal right to determine how or whether the work will be reproduced, distributed, displayed or performed.

Why do teachers need to know about copyright? Must educate users to respect copyright and use responsibly Must use it responsibly in their classroom.

WHAT IS FAIR USE the fair use of a copyrighted work, including such use by reproduction in copies…for purposes such as criticism, comment, news reporting, teaching(including multiple copies for classroom use), scholarships or research is not an infringement of copyright

True or False Since I work at a non profit educational institution everything I want to use in my classroom is allowed by fair use.

Fair Use Factors What is the purpose of the use? What is the nature of the work to be used? How much of the work will you use? What effect would this use have on the market for the original or for permissions if the use were widespread?

Public Domain Hirtle_Public_Domain.htm Hirtle_Public_Domain.htm

Nothing in copyright is certain “Fair use is decided on a case by case basis. There are no hard or fast rules. This means that one can never be 100% certain, no matter what the circumstances, that any given situation will be excused as fair use.” Copyright in cyberspace, Gretchen Hoffman, 2001
