Human rights also to electrosensible disabled persons Giorgio Cinciripini,

The convention on the Rights of persons with disabilities Convention Brochure Some its key points: – Disability as pathology of the society: it’s a result of failure of societies to inclusive and to accommodate individual differences … – … the social, legal, economical, political and environmental conditions that act as barriers to the full exercise of the rights by persons with disabilities need to be identified and overcome …

The convention plus its Optional Protocol were signed by almost all the UN’s countries (159). See the list here : Link. Check the dates and National Ratificatiion Law here: LinkLink

Monitoring Monitoring mechanisms: – At national level, States designated Focal Points within the Governments, a coordination mechanism and one or more independent mechanisms to promote, protect and monitor the Convention’s commitments – At International level, a Committee (located in Geneve) checks, dialogs and controls implementations within each State The Committee receives complaints from individuals or groups alleging violations of the Convention: the Committee after undertake inquiries in States in case of violations of the Convention

Complaint As part of the monitoring mechanisms, complaint can be delivered to the Committee to report violation of the Convention due to the State. No special legal concerns are required : the Committee receives it, makes considerations and after inquires to State about the concerned complaint.

What can we do ? Look at the local National law that ratified the convention and its optional protocol Look for the concerned Focal Point intitled to monitor the right acceptance of the convention’s concepts within the Laws and legislation Send to them questions about how they think to ensure better life conditions to electrosensibles After failed attempts to open a door, a legal action should be applied to the local Court If negative, a Complaint could be applied to the Geneve’s Committee
