PRAGATI

OBJECTIVE  To empower citizens through awareness of the Legislation called “ Government Servants Regulation of Transfers and Prevention of Delay in Discharge of Official Duties Act,2005.”

Outcome By 15 th May  Create 20 leaders.  Have 1000 application demanding services as per the provisions of the Act.  Have a citizen’s body to give effect to various facets of the Act so also initiate process of strengthening the Act.

Salient Features of the Act  Ordinance issued on 29 th August  Became an Act on 12 th May  Covers two broad areas:- Transfers of public Officials and Delivery of Services within prescribed time limits.

Current usage of the Act  The Act has been extensively used by the Civil Servants against arbitrary transfers.  However, provisions relating to services delivery has been rarely used.

Chapter III: Prevention of Delay in Discharge of Official Duties: Provisions CITIZENS CHARTER  Within 6 months of the coming into effect of the Act, every government office or department is to publish its citizens charter.  Disciplinary action can be taken of this is not given effect.

Delegation of Powers  Head of every office / department to publish the list of powers delegated to subordinate officers to take final decision.  Decisions within 3 levels  Delegated powers to be published within a year.

Delay in File Movement  File cannot be kept pending in the department for more than 7 days.  Immediate files to be acted upon within 2 days.  Urgent file within 4 days.  When file not required to be referred to other department- decision within 45 days.  When other department involved, decision within 90 days.

Disciplinary Action  Wilful or intentional delay can result in disciplinary action under Civil Services Rules  Entry into the Annual Confidential Report

Non application of Act  Sub-judice matters;  Cases referred to Lokayukta /Upa Lokayukta,Commission, Constitutional bodies;  Quasi judicial matters;  Cases related to other states and central governments;  Cases related to legislation;  Cases involving major policy decision;

Administrative Audit  Government to set up a mechanism within 12 months to carry out administrative audit to see if provisions of the Act are being given effect to.
