3Info-Tech Research Group Vendor Landscape: Court & Docket Management System Tribes have always had systems for addressing their internal conflicts and relationships. Historically, these systems were informal, unwritten, and based upon a holistic philosophy and culture. The development of tribal courts can be traced to a case occurring in the 1880s on what is now the Rosebud Indian reservation in South Dakota. It was not until 1934 that Indian tribes were allowed to set up their own justice codes and operate court systems enforcing tribal laws enacted by Indian tribes. The creation of those court systems is the result of the inherent authority of tribal nations to enact their own laws and to be governed by them. Today, tribal courts play a vital role in tribal self- government and the Federal government has consistently encouraged their development. Congress enacted the Indian Tribal Justice Act, which authorized funding for tribal courts and tribal judicial conferences, recognized inherent tribal sovereignty and the right of tribes to choose their own court systems, and created an Office of Tribal Justice Support in the Bureau of Indian Affairs. Market overview How it got here Where it’s going Automation of court operations is driven by the need to improve communication and ICWA compliance, and as tribes obtain funding from the Office of Tribal Justice Support and opt to establish their own court systems. When selecting the most suitable CDMS, first consider court services and jurisdictional limitations followed by the ability to integrate with other agencies and systems. Except for California where only a limited number of the 100 tribes have established courts, almost every tribe in the lower 48 has established some kind of tribal judicial system. However, the scope of some tribal systems is limited, particularly in P.L. 280 states. In addition, there are approximately 20 Courts of Indian Offenses established throughout the US under the Code of Federal Regulations (CFR) known as CFR Courts. These are courts established by the federal government that perform the function that a tribal court would fulfill. Tribes may enact their own tribal codes to be used by the CFR court, subject to approval by the Assistant Secretary of Indian Affairs, or tribes may opt out of the system by establishing their own court system. As more tribes establish their own court systems and technology resources enter additional areas of government services and operations, court automation solutions with data sharing and integration with other justice agencies (e.g. the police) and the ability to enable public access will become more widespread.
