WHAT IS “STOP AND FRISK”? Stop and frisk is “Temporary questioning of persons in public places.” Initiated in Supreme court in 1968 It violates the 4 th and 14 th amendments. Police officers stop a citizen, ask them for their name, address and a reason for their actions if they are being suspicious. While stopping this person, if the police officer feels in danger of his life or for others he is than allowed to search the person for a weapon.
WHAT IS SUSPICIOUS BEHAVIOR? Suspicious behavior includes furtive movements fidgeting changing directions walking in a certain manner grabbing one’s pocket looking over shoulder
HOW IS STOP AND FRISK NEGATIVELY PERCEIVED BY THE PUBLIC? Stop and Frisk is largely viewed as racial profiling 2004 to 2012, 83% of individuals stopped and frisked were black and Hispanic Judge Shira A. Scheindlin says Stop and Frisk policy consists of “black and Hispanics who would not be targeted if they were white.” In Brooklyn, 93 out of every 100 residents were stopped and frisked Town filled with minorities as 76.7% Black or African American, 17% Hispanic/Latino Individuals participating in the silent march against the Stop and Frisk in NYC
STOP AND FRISK VICTIMS 14 yr. old Tyrai Jenkins Was stopped and frisked three times One incident was while he was walking to his friends house and the cop approached him Had to empty out bag in front of officer officer was yelling “speed it up”. Police officer asked for ID, but Tyrai left it at home He had to be accompanied home by officer to be identified
STOP AND FRISK VICTIM #2 14 yr. old Ashley Fernandez has been stopped 7 to 8 times Ashley believes it is because she dresses like a “boy” One incident Ashley and her friends were walking to Mcdonalds when a police officer checked their bags Officer asked them if they were in a gang and they responded no; police moved on
STOP AND FRISK VICTIM #3 Anthony Henry,14 yr. old, had a similar experience as Ashley Officer asked if he was in a gang, Anthony said no Officer did not believe Anthony, took him home, had Anthony's mother identify him Once officer found out that this was the wrong person he just responded with a pat on the Anthony's head and a “My Bad”
STOP AND FRISK VICTIMS The Amadou Diallo case is a common reference of evidence to racial profiling In 1999, police shot Diallo, who was unarmed and a Guinean immigrant Soon after, the Center for Constitutional Rights sued the NYPD for racial profiling

HOW IS STOP AND FRISK POSITIVELY PERCEIVED BY THE PUBLIC? Mayor Bloomberg supports Stop and Frisk States “There is just no question that Stop-Question-Frisk has saved countless lives.” In 2011, NYPD recorded 686,000 stops Only 82 stops resulted in arrests Bloomberg and Police Union believe the Stop-and Frisk- tactics have been a crucial factor in reducing crime rate
HOW HAS NYC CHANGED THE STOP AND FRISK POLICY? after the Amandou Diallo, the NYPD wrote an anti-racial profiling policy the NYPD spent over $12 million dollars in order to set up a database that records individuals who were stopped and frisked allows for the NYPD to search records during investigation the Center for Constitutional Rights filed a lawsuit claiming that Stop and Frisk is an unconstitutional act
