Problem Locations and the Community Safety Ordinance Presented to the Planning Commission June 14, 2007

Community Safety Ordinance Goal: Mechanism to reduce drains on resources. Intent: Work with property owners in a cooperative fashion before cooperative fashion before enforcement. enforcement. Comprehensive notification & enforcement process to deal with (1) chronic crime and (2) quality of life issues for residential and commercial locations

Community Safety Ordinance Ordinance Origins: Community Health Action Team (CHAT) Need for swift tool against Chronic Nuisance Properties. (Not in lieu of the Planning Commission, but rather an additional tool) City Survey (Vacaville, Oakland, Portland, Denver, etc.) Draft modeled after Vacaville ordinance.

Community Safety Ordinance Ordinance Objectives: Expeditiously and effectively address Nuisance Properties. Deny the use of real and personal property to further criminal activity. Obtain owner/tenant cooperation in removing the criminal element from specific addresses. Impose fines and seek other judicial relief from owners/tenants who fail to comply. Specifies no housing discrimination or evictions based on prejudice (Must be incident specific).

Community Safety Ordinance Key Features: Abatement of chronic nuisance properties in cooperation with owners/tenants. Focus on repetitive/chronic crime-related activity and quality-of-life issues. Recovery of administrative and personnel costs associated with ordinance enforcement. Enhanced fines and penalties for ordinance violations.

2006 Analysis of potential business / commercial nuisance locations based on calls-for-service (CFS) and crime statistics, as requested by the Planning Commission

November 2006 A list of potential problem locations was developed by the Police Department: 1.Cal Park Liquors (702 N. California St.) (Community Safety Ordinance in progress) 2.Cigar Face (8037 N. West Lane) (Problems reduced, Private Security change) 3.City Motel (1005 N. El Dorado St.) (Closed due to Code Enforcement violations) 4.Delta Liquors (519 W. Charter Way) (Meetings with Property Owner, Problems reduced)

List of 2006 Potential Problem Locations (CONT): 5. El Alteno Bar (2302 E. Main St.) (Many CFS in 2006 to only 8 CFS in 2007) 6. El Amigo Bar (2163 S. san Joaquin St.) (Agreed to remove payphone) 7. Flamingo Club (1233 E. Charter Way) (Problem resurfaced – PD/permit meeting pending) 8. Gray’s Liquors (2007 S. El Dorado St.) (Reduced problems, Reduced CFS)

January 2007 Community Safety Ordinance presented to, and adopted by, the City Council Research of numerous potential locations to be addressed by the ordinance

February-June 2007 FEB: 38 possible locations identified to be addressed by the ordinance. APR: Narrowed down to the 6 most significant problem locations that the ordinance specifically addressed. MAY: May 16 th notification letters sent. JUNE: June 3 rd and 4 th meetings with property owners, City Atty, and SPD. Deadlines for enforcement to begin is June 16, Deadlines for enforcement to begin is June 16, 2007.

6 Locations Town House Inn (1604 N. Wilson Way) -Owner states will not rent to prostitutes Buggy Bath (1646 N. Wilson Way) -agreed to install fence, additional cameras, and possibly pool for security Liquor Barrel (1702 N. Wilson Way) -agreed to pool for private security, lighting

6 Locations (Cont) Señor Taco (1730 N. Wilson Way) -agreed to remove benches, increase lighting, clean graffiti & trash Cal Park Liquor (702 N. California St.) -was advised of problems and ordinance enforcement Apartments at 421 S. California St. -owner failed to appear. -current active Code Enforcement case.

Problem Locations SPD District Commanders will continue to identify locations for within the policing districts.
