STOP Ordinance Amendments “STOP”

STOP Implementation Implementation of the Red Light Camera and Speed Enforcement Program requires completion of two items: 1.Approval of Ordinance enacting the LCMC 1997 Section 27-7 ET SEW, the Safe Traffic Operations Program. 2.Approval of a Resolution initiating the program and awarding the contract for equipment installation to Red Flex Traffic Systems of Phoenix, Arizona.

Safe Traffic Operations Program Amendments to Ordinance Due to Legislative Changes Amendments are proposed to the “red light cameras” ordinance, No. 2495, because of amendments made by the 49th Legislature in Senate Bill 519. The amendments include: The District Court appoints the Hearing Officer (change fromThe District Court appoints the Hearing Officer (change from hearing officer who contracts with City); Fines assessed for a maximum amount of $100 for running a red light or speeding (change from scale of fines forFines assessed for a maximum amount of $100 for running a red light or speeding (change from scale of fines for speeding); and speeding); and Hearings conducted following the rules of evidence and civilHearings conducted following the rules of evidence and civil procedure for the district courts (change from informal hearing).

Options Adopt the ordinance. Adoption means that the City’s Safe Traffic Operations Program ordinance will comply with legislative amendments to state law. Do not adopt the ordinance. This means that the City’s Safe Traffic Operations Program will not comply with legislative amendments to state law. Modify the ordinance and provide further direction to staff.

STOP Ordinance Fines Fines for running of a red light: 1 st Violation - $100 2 nd Violation - $125 3 rd Violation - $175 (within 2 yrs of first violation) Fines for speeding: 10 miles/hr over the speed limit - $ miles/hr - $ miles/hr - $ miles/hr - $ miles/hr - $ miles/hr - $200 More than 35 miles /hr - $250

STOP Ordinance Albuquerque Ordinance used as model. Governs the “STOP” program for both speed and red light violations. There is a significant risk to the health and safety of the community from drivers who run red lights and exceed posted speed limits. Makes red light and speed violations a civil offense.

REDFLEX CONTRACT Redflex Compensation per month: 1 to 90 citations at rate of $48 per paid red light or speed citations per system. 91 to 180 citations at a rate of $38 per paid red light or speed citations per system. 181 citations and above at a rate of $28 per paid red light or speed citation per system.

Lessons to Learn From the Albuquerque Program Lessons to Learn From the Albuquerque Program Allow any excess fine collection revenue to be used by the L.C. Police Department and the City’s Traffic Engineering section for service enhancement and public safety. Do not utilize in the general fund. The City must have a clear pre-implementation public relations program. RedFlex will assist and encourages advanced implementation of public relation and public notification of the project. Albuquerque’s fines were arbitrary and significantly different (higher) than their normal traffic fines for similar offenses.
