Department of Justice cracking down on hotels with $100,000 in penalties Imposed upon Non-compliant Pools for ADA Mandate Does your pool have a fixed lift? Become compliant today with a high quality and safe pool lift from Leisure Aquatic Products for only $2,000

Safety First The Americans with Disability Act (ADA) had ruled that every public pool and spa is required to be handicap accessible by March 15, 2012

ADA Title III Lawsuit Numbers The amount of lawsuits for non compliant pools is increasing each year. It is more important than ever to make sure all your pools have a fixed lift. Consider that a $2000 lift will bring a pool to compliance and save money over penalties and litigation costs.

ADA Title III Lawsuit Numbers Certain states have had more lawsuits due to non compliant pool access over others. In 2015 and 2016 lawsuits are starting to increase in states that didn’t have as many beforehand.

Hotspots for Lawsuits Mostly Vacation Destinations and Populated States have the most lawsuits due to lack of pool lift. Don’t get stuck with a huge fine or lawsuit! California Florida New York Arizona Minnesota

Maximum Fine Imposed Was $55,000 Raised to $75,000 $150,000 for subsequent violations The Department of Justice is raising the penalty amount for not having a compliant lift access to your pool. How much do you think the penalty is?

Consider court fees How much does your lawyer cost per hour? Going to court to argue that your hotel cannot afford a lift, will cost you much more than a $2,000 lift. Plus consider the fines and the possibility of having to add a lift anyways.

Readily Available Provision The Department of Justice expects all businesses that cannot afford a lift now, to get one as soon as they can afford it. The pressure to do so increases each year as lawsuits have increased. Consider that it is 4 years past the mandatory compliance date, if your pool is operational to guests, you need a pool lift for safety.

Tax Credits are available Learn more about tax deduction provisions for pool lifts at (voice) (TTY)

Questions regarding Lift Requirements The ADA standards are available at (voice) (TTY) Attached is a PDF with Answers to most Lift Questions regarding ADA standards

Benefits of ADA Compliance Disabled population is the largest minority group in America at over 55 million with over $200 billion in spending power. $4.2 billion is spent by people with disabilities in the lodging industry each year. It is estimated that spending could increase to $27 billion of certain needs are met, such as pool accessibility.

Benefits of ADA Compliance Americans 50 and older represent 25% of the population but control 50% of the nations buying power and 75% of its assets. The 2000 US Census reports that almost 42% of adults 65+ have one or more disabilities. Between 2000 and 2030, the number of Americans over age 65 will more than double from 34.8 million to more than 70 million.

Benefits of ADA Compliance Recover your costs of modification and get a return on your investment The US Government provides annual tax incentives for the removal of barriers to make facilities more accessible to people with disabilities Designing special programs for your pools and spas that target the disabled and aging populations to drive more customers to your fitness center, aquatic facility etc… can increase your revenues and help pay for the costs of barrier removals.

Benefits of ADA Compliance Minimize risk of litigation By making your facility ADA compliant you are limiting the risk associated with not complying with the Federal ADA requirements. Although the Department of Justice will not typically come out and inspect your existing facility for ADA compliance you may be open to lawsuits filed by individuals OR if you apply for Federal grant monies for your facility, ADA compliance may become a factor in getting approved. Lawsuits are increasing in year 4 of ADA compliance. Don’t get caught paying over $100,000 in penalties and lawyer fees. Buy a $2000 lift to become compliant.

These great lifts are the cheapest in the country. Lifts are high quality and will make sure your pool is ADA compliant! Click the lift to view and order at our website.
