Migration and asylum Statistics of International Migrations Migrations flows Current situation  Statistics of international migrations (migrations flows) is collected from 2010 (2009 -Pilot);  The source of data is the Register of permanent or temporary residence of Montenegrin citizens and foreigners from Ministry of the Interior;  Definitions in accordance with regulative 862/2007, except definition on emigration. Migrations and asylum Statistics of International Migrations Population stocks of foreigners and foreign-born Acquisition of citizenship Current situation  Population according to citizenship and the country of birth – Submitted data for 2010, which are done on the basis of the data from Census  Acquisitions of citizenship – Registry of Montenegrin citizens at Ministry of the Interior. Definitions are in accordance with regulative. The data are not submitted. Migrations and asylum Statistics of International Migrations Plans  Signing an Agreement between Ministry of the Interior and Statistical Office shall contribute the elaboration of the legal obligation of Ministry of the Interior of data submitting from the field of acquisition and loss of citizenship;  Harmonization with the definition of emigration;  Harmonization of the population registry with the needs of Statistics. Migrations and asylum Asylum Current situation  The Directorate of Asylum at the Ministry of the Interior is responsible for evidence of asylum seekers;  Positive legal system in Montenegro in the field of asylum is largely in accordance with the Regulative 862/2007;  There are not data about approval or revocation of residence permit for humanitarian reasons and about resettlement of people to third country;  The data is not submitted to EUROSTAT. Migrations and asylum Asylum Plans  Signing an Agreement between Ministry of Interior and Statistical Office shall contribute the elaboration of the legal obligation of Ministry of Interior of data submitting from the field of asylum;  Creating of electronic evidence of asylum seekers, with the basic data of seekers which are complementary to data in the article 4 of Regulative 862/2007;  National database of asylum seekers shall be harmonized with system EURODAC and Dublin convention and shall be in function till the end of STATISTICS Chapter 18: M O N T E N E G R O Negotiating Team for Accession of Montenegro to the European Union Chapter 18: Statistics

Migrations and asylum Residence permits Current situation  Administrative source of data- Registry for foreigners at Ministry of the Interior  Positive legal system in Montenegro in the field of residence permits is largely harmonized with Regulative 862/2007;  Non–compliance with regulative: -Definitions of the first and renewable permit, -Period of temporary residence, -Reasons for issuing residence permit and -The change of immigration status or residence reason;  The data is not submitted to EUROSTAT. Migrations and asylum Residence permits Plans  Signing an Agreement between Ministry of the Interior and Statistical Office shall contribute the elaboration of the legal obligation of Ministry of Interior of data submitting from the field of residence permits;  In order to fully transpose directives in the Montenegrin legal system, it is necessary to amend the Law on Foreigners, Law on Employment and work of foreigners and relevant regulations. Migrations and asylum EIL Current situation  Police Directorate, at Ministry of Interior, keeps records of persons to whom entries are forbidden, who are in illegal residence, persons with territory leaving deadlines and with protection measure of removal from Montenegro;  Positive legal system in Montenegro in the field of illegal migrations (EIL) is largely harmonized with Regulative 862/2007;  Non–compliance with reasons for rejecting the entrance;  The data is not submitted to EUROSTAT. Migrations and asylum EIL Plans  Signing an Agreement between Police Directorate and Statistical Office shall contribute the elaboration of the legal obligation of Police Directorate of data submitting from the field of EIL;  Harmonization with the regulative;  Creating of electronic database, with the basic data which are in accordance with the regulative.
