General Note 1 “The purpose of this plan is to show the replacement of an existing wood utility pole with a steel monopole and an elevated equipment/generator platform to be used for wireless communication.” 13

Monopole A wireless communications facility (WCF) or site that consists of a single pole structure, designed and erected on the ground or on top of a structure, to support communications antennas and connective appurtenances… §

Non-tower-based WCF All non-tower-based wireless communications facilities, including, but not limited to, data collection units, communications antennas, and related equipment. Non-tower-based wireless communications facilities shall not include support structures for Communications Antennas and related equipment… §

Support Structure or Structure STRUCTURE Any man-made object having an ascertainable stationary location on or in land or water, whether or not affixed to the land. All buildings and all satellite dish antennas are structures. Structure = anything WIRELESS SUPPORT STRUCTURE A freestanding structure, such as a tower-based wireless communications facility (WCF) or any other support structure…. Support Structure = tower §

Wireless Support Structure A freestanding structure, such as a tower- based wireless communications facility (WCF) or any other support structure that could support the placement or installation of a non- tower-based wireless communications facility, if approved by the Township. §

Non-tower-based WCF All non-tower-based wireless communications facilities, including, but not limited to, data collection units, communications antennas, and related equipment. Non-tower-based wireless communications facilities shall not include support structures for Communications Antennas and related equipment… §

Communications Antenna Any structure or device used for the purpose of collecting or transmitting electromagnetic waves, including, but not limited to, directional antennas, such as panels, microwave dishes, satellite dishes and omnidirectional antennas such as whip antennas. “Communications antenna” shall not include tower-based WCFs defined below… §

WCF, Tower-Based Any ground-mounted structure that is designed and constructed primarily for the purpose of supporting one or more communications antennas for wireless communications purposes, including self- supporting lattice towers, guyed towers, or monopole towers… The term includes the structure and any supporting structures thereto. §

Wireless Support Structure A freestanding structure, such as a tower- based wireless communications facility (WCF) or any other support structure that could support the placement or installation of a non- tower-based wireless communications facility, if approved by the Township. §

Applicable Code for development of WCF site w/88 ft tower Code regulates design and construction of: TOWER § B NON-TOWER § D TowerYes No, tower prohibited FencingYesNo LandscapingYesNo Access roadYesNo Distance from residential property line Yes, 200’ minimum No Limits zoning districtYes, no R-1No Maximum heightYes, 200 feet Yes, 15’ above existing struct. Accessory equipmentYes 22

Site Plan § B.(3) requires that tower- based WCFs be located a minimum of 200 feet or 110% of tower height, whichever is greater, from any existing residential lot line 23

Site Plan, continued The Bannon property line is 125 ft. from the proposed monopole 24

Site Plan, continued The Rabian property line is 75 ft. from the proposed monopole 25

Site from 1098 Cortland 26

Applicable Code for development of WCF site w/88 ft tower Code regulates design and construction of: TOWER § B NON-TOWER § D TowerYes No, tower prohibited FencingYesNo LandscapingYesNo Access roadYesNo Distance from residential property line Yes, 200’ minimum No Limits zoning districtYes, no R-1No Maximum heightYes, 200 feet Yes, 15’ above existing struct. Accessory equipmentYes 27

Summary of Code Issues Code limits on tower-based WCFs outside of public right-of-way make the site ineligible for a TOWER- BASED WCF. The site is located in an R-1 zone. § B(1) limits tower-based WCFs to I-1 or UPD Subdistricts 8,9,10,11 zoning. The tower is located 75 feet from an R-1 property line. § B(3) requires it be at least 200 feet from any residential property line. 28

Conclusion The Lemont/Cortland Drive site proposal is for the construction of a monopole for wireless communications. The WIRELESS COMMUNICATIONS FACILITIES, TOWER-BASED section of the code regulates this project. We, the neighbors proximate to this site, submit to the planning commission that code requires that section B., “Tower-based wireless communications facilities outside the rights-of-way,” control the proposed WCF, maintaining the uniform property development that code enforcement promotes. 29
