© Windsor-Essex County Health Unit, September 2013 Windsor-Essex County Board of Health passed an updated resolution in November 2015: “Encourage all Windsor-Essex municipalities to develop and adopt by-laws prohibiting smoking, smokeless tobacco use, and lighted or heated smoking equipment such as hookah/waterpipe, and e-cigarettes in all municipally owned outdoor sport and recreation areas, as well as parks, beaches, trails, playgrounds, 9m from entrances/exits of municipal buildings, transit shelters, and outdoor hospital grounds.” SFOS AND SMOKE FREE ONTARIO STRATEGY

© Windsor-Essex County Health Unit, September 2013 BENEFITS OF SFOS POLICY IMPLEMENTATION 1. Reducing health risks of second-hand smoke There is no risk-free level of exposure to tobacco smoke 1. Depending on proximity and wind conditions, exposure to second-hand smoke can be just as high outdoors as indoors De-normalizing Tobacco Use Smoke-free outdoor spaces assists in de-normalizing tobacco use 3. The Scientific Advisory Committee (SAC) feels that protection beyond the Smoke Free Ontario Act would assist in reducing social exposure to smoking- specifically to help reduce children and youth from starting to smoke 4.

© Windsor-Essex County Health Unit, September 2013 BENEFITS OF SFOS POLICY IMPLEMENTATION 3. Healthier Environment Cigarettes are the number one recovered littered item on beaches in Canada 5. 22% of the Windsor-Essex population are current daily smokers (including occasional smokers); therefore there are about smokers in Windsor-Essex 6. Daily smokers smoke an average of 14 cigarettes per day 7. In total, there are over 383 million cigarettes deposited in Windsor-Essex on an annual basis.

© Windsor-Essex County Health Unit, September 2013 SMOKE FREE ONTARIO ACT (SFOA) & AMENDMENTS O. Reg. 48/06 enacted on May 31, 2006: Prohibited smoking in enclosed workplaces and public spaces. O. Reg 206/14 effective Jan 1, 2015: Prohibits smoking on all bar and restaurant patios Prohibits smoking on playgrounds, and within 20 metres Prohibits smoking on sporting areas and spectator areas, and within 20 metres (includes municipally or provincially owned sports fields and post secondary education campuses) The sale of tobacco on post-secondary education campuses. The SFOA is enforced by WECHU’s Tobacco Enforcement Officers

© Windsor-Essex County Health Unit, September 2013 MAKING HEALTHIER CHOICES ACT – PROPOSED Bill 45: Introduced November 24, 2014 Includes proposed prohibitions on: The sale and supply of e-cigarettes to anyone under the age of 19. The use of e-cigarettes in certain places where the smoking of tobacco is prohibited. The sale of e-cigarettes in certain places where the sale of tobacco is prohibited. The display and promotion of e-cigarettes in places where e-cigarettes or tobacco products are sold, or offered for sale. The sale of flavoured tobacco products, including menthol Increases maximum fines for those who sell tobacco to youth. Strengthens enforcement to allow for testing of substances used in waterpipes in indoor public places.

© Windsor-Essex County Health Unit, September 2013 INTEGRATING REGULATIONS The Ministry of Health and Long Term Care (MOHLTC) requires that 10x10cm signs with universal no-smoking symbol be posted By-law signs will remain posted and be the focal point for education (superseding regulation) Three enforcement scenarios: Infractions made within prohibited areas covered under both the SFOA and municipal by-laws will be enforced through provincial enforcement channels Infractions made within prohibited areas covered under the SFOA will be enforced through provincial enforcement channels Infractions made outside of the SFOA but covered by the municipal by-law will be processed through municipal enforcement channels

Outdoor smoking policies tend to be self-enforcing, when combined with proper education and signage. WECHU could assist with the implementation of an Essex County wide by-law in the following areas: Enforcement – compliment existing enforcement activities under the SFOA prohibitions Public awareness campaign development and implementation Signage Evaluation

© Windsor-Essex County Health Unit, September 2013 A UNITED COUNTY WIDE APPROACH – BENEFITS CLARITY - One set of rules with clear prohibitions on spaces and products from one municipality to the next RESPONSIVE – Supports actions of municipalities and public demand LEADERSHIP - Continue to be viewed as a provincial leader in smoking/tobacco control PROGRESSIVE - Planning ahead for anticipated provincial regulations PROTECTION – Provides a higher level of protection than provided by the province for municipalities that do not have local policies

© Windsor-Essex County Health Unit, September 2013 REQUEST FOR CONSIDERATION WECHU is asking Essex County Council to consider and support a motion to proceed in seeking municipal support, in the form of council resolution, for an Essex County-wide smoke-free outdoor space by-law. Goal of this strategy: Develop comprehensive, representative, and consistent protections against the harms of smoking and tobacco in municipally owned outdoor spaces. Demonstrate leadership in Ontario towards the development of healthier, safer, and cleaner community.
