Updated on CSO-Government Relationships, LANGO, SDGs and GPP Board-ED Seminar KSSA, Diakonia Center 17 December 2015 EL Sotheary, Head of Program Vision: Sustainable Development for Cambodia

2 Presentation Outlines 1.Global rating on Cambodia 2.Government and CSOs relationships 3.Update on LANGO 4.Update on SDGs 5.Key considerations for the Board and Management regarding these contexts 6.Update on GPP

3 1. Global Rating for Cambodia -Corruption: 157/170 nations, TI Corruption Perception Index Freedom in the World Status: not free, Freedom House Rule of Law: 99/102 nations, World Justice Report Failed State Index (0-120, higher is less stable): 88, Fund for Peace CSO Sustainability Index (4.2): MSI 2014

4 2. Government and CSOs relationship -CSOs vary depending on the type of organizations (LNGOs, INGOs, CBOs, & Traditional Associations). -4,000 registered NGOs ( Only 1,315 active) -Gov’t welcomes CSOs working for service delivery rather than policy change and advocacy… -Gov’t welcomes CSOs in the implementation of ISAF to promote accountability at the sub-national level -Several laws (LEMNA, LANGO) recently passed and few pipeline laws (Union law, Cybercrime law, etc.) -Funding relatively decreased (currently, 85% of CSO funds from foreign aids)

Large Umbrella Organizations CCC, NGO Forum, MEDiCAM (bridge / coordinate sector voice / concerns to sub-national, national, regional, and global levels) Sectoral/Regional Networks (address or advocate for sector changes) NGOs (respond or advocate for social changes) CBOs Informal Groups Citizens (demand for social changes) National Level Government ministries/ departments/authorities MoFA/IC MoU/ line ministry agreements 19 Technical Working Groups Annual Government and NGO meeting, DCPS Sub-National Level Committees (CWCC, etc) Public fora Implementation of Social Accountability Framework (ISAF) Local development planning process (CDP, CIP, etc) 2. Government and CSOs relationship (cont.)

Strategies for improving CSOs + Government relationships  Maximize using invited spaces (local, national, regional and international - linkages) to voice concerns and generate supports  Realization of inclusive partnership principles (OGP, Busan, SDGs)  Financial freedom: for addressing structural changes vs project base  Active citizenship (education, mobilization, campaign, citizens monitoring, pro-poor policies)  ICT center-approaches  CSO’s space, sustainability and effectiveness

3. Update on LANGO: Its Implications  No Registration, no any activities allowed  Vague, unclear, open to interpretation: unclear who needs to register and as what? Ex/ neutral, audit if necessary, violate national culture..  Just to provide legitimacy for the government  Create fear, self censorship, particularly for CBOs and Human Rights NGOs……. -Registration cost -Reporting and administrative cost

3. Update on LANGO: Its Implications (Cont.)  Report on Bank Account within 30 days  Report on adjustment or changes within the organization  INGOs shall sign MoU with MoFA/IC and line ministries  Comply with Taxation, Immigration or Labor Law  Submit its annual activity and financial report  Check and audit an association and NGOs (if necessary).  Sanction, fine, and omit from the list of NGOs/Associations.

4. Update on SDGs 1.Social Inclusion and Human Development 2.Inclusive Economic Development 3.NRM and Ecological Development 4.Good governance and Inclusive Partnership 5.Human Rights to Development SDGs Perspectives Proposed by CSOs

4. Update on SDGs

4. Update on SDGs (Ways Forward)  Enforce inclusive partnership for development and financing for SDGs  Meaningful participation of all development actors in the localization process  Enforce the accountability, transparency and M&E mechanism  Promote and enforce human rights based approach to development.

5. Key Considerations  How can we promote the capacity and preparedness of the organizations towards: LANGO, SDGs, and other development challenges  What mechanisms are locally available to promote good governance and inclusive partnership within and out of the organizations?  How the Board and the management can better response and involve in promoting good governance for the organizations?
