UN Committee on the Inalienable Rights of the Palestinian People Brief background Comparison with the 'Special Committee Against Apartheid' Strategy suggestions Prepared by: BADIL Resource Center for Palestinian Residency and Refugee Rights, June 2007

Background Establishment: November 1975, GA Res (XXX) Division for Palestinian Rights (1977) Mandate: to consider and recommend to the Assembly a programme of implementation, designed to enable the Palestinian people to exercise its inalienable rights defined in GA Res (XXIX): self-determination return to homes and properties

Background cont. Members: Afghanistan, Belarus, Cuba, Cyprus, Guinea, Guyana, India, Indonesia, Lao People's Democratic Republic, Madagascar, Malaysia, Mali, Malta, Namibia, Nigeria, Pakistan, Senegal, Sierra Leone, South Africa, Tunisia, Turkey and Ukraine. Observers: Algeria, Bangladesh, Bulgaria, China, Ecuador, Egypt, Iraq, Jordan, Kuwait, Lebanon, Libyan Arab Jamahiriya, Mauritania, Morocco, Nicaragua, Niger, Qatar, Sri Lanka, Syrian Arab Republic, United Arab Emirates, Bolivarian Republic of Venezuela, Viet Nam, Yemen, African Union, League of Arab States, Organization of the Islamic Conference and Palestine.

Work Recommendations (1976): Two-phase plan for the return of Palestinians to their homes and property; Timetable for the withdrawal of Israeli forces from the occupied territories by 1 June 1977, with the provision, if necessary, of temporary peacekeeping forces to facilitate the process; End to the establishment of settlements; Recognition by Israel of the applicability of the Fourth Geneva Convention to the occupied territories pending withdrawal; and Endorsement of the inherent right of Palestinians to self- determination, national independence and sovereignty in Palestine.

Review, if they have not yet done so, in conformity with their national legislation, their economic, cultural, technical and other relations with Israel, and the agreements governing them with the aim of ensuring that these regulations and agreements will not be interpreted or construed as implying in any way recognition of any modification of the legal status of Jerusalem and of the Palestinian and other Arab territories occupied by Israel since 1967, or an acceptance of Israel's illegal presence in those territories Assure the observance of the stipulations provided in General Assembly resolution 181 (II) guaranteeing to all persons equal and non-discriminatory rights in civil, political, economic and religious matters and the enjoyment of human rights and fundamental freedoms, including freedom of religion, speech, publication, education, assembly and association

Encourage, in conformity with their national legislations, the formation of national committees in support of the Palestinian people To consider, in the event of Israel's persistent non- compliance with the relevant United Nations resolutions which embody the will of the international community, appropriate measures in accordance with the Charter of the United Nations, to ensure Israel's compliance with these resolutions
