4 Best Practicable Means at Carnwath Road As well as standard best practice of using the quietest available plant and operating it in the quietest way (no revving of engines of unnecessary idling etc) the COCP commits us to: A noise enclosure around the shaft during tunnelling A noise enclosure around 3 sides of the material handling area Noise screens around plant Noise screens at the barge loading area Noise barriers around the site Applications to the Local Authority under s61 of the Control of Pollution Act specifying the works, equipment, mitigation and predicted noise levels

5 What is Section 61? “Prior Consent” for noisy works (includes vibration) – Control of Pollution Act (CoPA) 1974 Sets out -Method statement (what we will do and how) -Plant list -Noise calculations (following British Standard guidance) at each of the receptors -Mitigation measures -Construction monitoring locations Local authority can attach conditions to the consent

8 Special Cases Special cases are defined by the Non Statutory Off-site Mitigation and Compensation policy as those who may have special circumstances such as a shift worker or vulnerable persons who may be housebound or have a medical condition exacerbated by noise and/or vibration. Individuals wishing to apply as a special case should contact the project in the first instance, the case will then be referred to the Independent Compensation Panel who will determine or ratify the appropriate mitigation for the individual’s circumstances.

10 Conclusion Noise is unwanted sound – reactions are subjective New baseline monitoring is being undertaken and so baseline assumptions will be updated We will predict noise levels based on the actual works proposed by the contractor, and these have to be approved by the local authority before we can start We will do all we can to mitigate noise and disturbance Where levels are too high and BPM has been exhausted we will implement the off-site mitigation policy (TAPS) We will monitor noise, and where necessary vibration, during construction The section 61 will be regulated by the local authority Residents should contact the helpdesk if concerned on
