Transfer Exceptions and Application

Common Transfer Triggers SA attended a class while enrolled full time at a collegiate institution. SA reported for a regular squad practice. SA participated in athletics while enrolled less than full time. NCAA Division III Bylaw

Base Transfer Rule A SA who transfers to a member institution from any collegiate institution is required to complete an academic year in residence at the certifying institution before being eligible to compete or receive travel expenses. Bylaw

Transfer Exceptions Identify type of transfer. Create timeline. Use resources.  Transfer tracer.  Registrar’s office.  Official transcripts.  Internet search. NCAA Division III Bylaw

Key Questions Did SA have an unfulfilled year of residence upon leaving previous institution(s)? Did SA transfer due to disciplinary suspension? Bylaw

Transfer Exceptions Locate legislation. Typical Transfers 4-4 transfers. Bylaw and Bylaw Other Exceptions Exchange student exception. Bylaw Two-year nonparticipation. Bylaw

Four-Year Transfers

4-4 Transfer Exceptions SA never participated in intercollegiate athletics; or (A) Nonparticipant SA athletically and academically eligible at time of transfer; or (B) Eligible Previous school did not sponsor sport; and SA earned > 24-semester/36-quarter hours of transferable degree credit. (C) Nonsponsored Sport Bylaw  SA could be immediately eligible if:

Divisions I and II 4-4 Transfers Question to ask:  Why is the SA not eligible? Progress-toward-degree requirements.  Divisions I and II progress-toward-degree waivers. Year in residence.  Division III legislative relief wavier.  Help !

RSRO Question football transfer (DIII to DI to DIII). Does not meet an exception, but… DIII Tracer SA left academically and athletically eligible. DI Tracer Did not play football. Attended for one term. Academically and athletically eligible. Left with unfulfilled residence requirement.

New Waiver Guidelines transfers who:  Did not participate in intercollegiate athletics at most recent four-year institution.  Would have been athletically and academically eligible at: Original four-year institution; and Most recent four-year, but for an unfulfilled residence requirement.

Two-Year Transfers

2-4 Transfer Exceptions Never practiced or competed in intercollegiate athletics. (A) Nonparticipant Never attended four-year school; and Athletically and academically eligible at two-year at time of transfer. (B) Eligible Bylaw  SA could be immediately eligible if: Or

(C) Attended two-year school for > two semesters or three quarters; and Earned > 24-semester or 36-quarter hours of transferable degree credit. RSRO Question (cont.) transfer. First Two-Year: SA enrolled full time and competed for two years.  SA left athletically and academically eligible. Second Two-Year: SA enrolled part time.  SA left academically ineligible. A. Nonparticipant B. EligibleC D. Terms and Credits

RSRO Question (cont.) SA is athletically and academically eligible at DIII school. Summer 2015 SA disciplinary suspended. Required to spend academic year away SA attends two-year school full time. Earns 21 transferable credits. Fall 2016 SA transfers back to original four- year school.  return to original institution.

2-4 Transfer Exceptions Athletically and academically eligible at first four-year institution at time of transfer to certifying institution. (C) Attended two-year school for > two semesters or three quarters; and Earned > 24-semester or 36-quarter hours of transferable degree credit. (B) 24/36 Bylaw  SA could be immediately eligible if: Or

4-2-4 Transfer Was the SA academically eligible at the first four-year institution at the time of triggering transfer back to that institution?

Multiple Transfer Determine transfer pattern. Apply legislation   2-4.

Other Transfer Issues

Two-Year Nonparticipation SA is eligible if he/she has not participated in their sport for at least two calendar years before the date the SA begins participation at the institution. Bylaws and

Two-Year Nonparticipation Time before SA first enrolls in college does not count. Two calendar years must be consecutive. Practicing or competing on a college or amateur team while enrolled in college would count as “participation.” Nonparticipation is sport specific.

RSRO Question  Does two-year nonparticipation supersede academic ineligibility? Spring 2014 SA initially enrolls at four- year school. SA practices in basketball and SA enrolled at same four-year. SA does not participate in college athletics. SA leaves ineligible. Fall 2016 SA wants to transfer to your institution to play basketball.

Two-Year Nonparticipation What else do you need to ask? Practice or competition on amateur team while enrolled in college counts as participation.  E.g., YMCA team, community rec league, intramurals etc.  Includes individual participation in organized competition.

International Student-Athlete Certification

Common Issues 1.Lack of clear information. 2.Delayed enrollment and organized competition prior to collegiate enrollment. 3.Club teams. 4.International transfers.

Delayed Enrollment and Organized Competition Individual who does not immediately enroll in college one year after his or her high school graduation date shall use a season of eligibility and sit an academic year if he or she… Bylaws and

Constitutes Use of Season Pro Team Competes or trains with team that awards expenses to any team member above actual and necessary. Payment Receives expenses above actual and necessary for any competition or training. Receives pay based on place finish. Contract/ Draft Competes after signing a contract for athletics participation. Competes after entering professional sports draft. Booster Competes in event funded by a booster that is not open to any and all.

RSRO Question After graduating high school, Canadian PSA played two years of club hockey. Did he use a season? Questions to ask:  Did SA or teammates receive expenses above actual and necessary?  Was it considered “Major Junior” ice hockey? Pro Team Payment Contract/DraftBooster

Club Teams and International Transfers

Club Teams Participation on a collegiate institution’s club team is exempted from using a season, if the institution does not sponsor the sport on a varsity intercollegiate level. Bylaw

RSRO Question Men’s tennis PSA immediately enrolls full time at an international collegiate institution after completing secondary education. He participates for the institution’s club tennis team both years. Did he use a season?

Questions to Ask Does the institution sponsor tennis at the varsity level?  No, but… Does club team have varsity characteristics?  Elite SAs chosen to be members.  Institution provides: Funds for travel and equipment. Coach’s salary. Scholarships. December 18, 2000 Educational Column

In Summary Delayed Enrollment Is this a collegiate institution? Was he enrolled full time? Club Team Does institution sponsor varsity tennis? Is this truly a club team? Transfer Exceptions Which 4-4 transfer exception applies?
