Why Citizenship May Be Denied (Form N-400) U.S. Immigration Center Toll Free Helpline:

1. Selective Service Males between ages 18 and 26 are required to register for Selective Service. If a citizenship applicant has failed to do so, his case may be denied. The time to re-file would usually be at age 31. But there may be exceptions, as there are with all rules.

2. Fraud before green card Immigration takes a look back at a naturalization applicant’s whole history. If the officer determines that a green card was issued (even many years before) in a fraudulent manner, citizenship may be denied. Even if the fraud was an innocent mistake, the case can be denied.

3. A Criminal History When applying for citizenship, the United States Citizenship and Immigration Services will obtain the individual’s biometrics and then run a background check to see if they have committed any crimes in the U.S. or their home country. Certain crimes such as murder and aggravated assault will automatically bar an applicant from becoming a U.S. citizen for life.

4. Taxes Failure to pay taxes is a very common ground for denial. Make sure that you talk to an outstanding immigration lawyer (and a good accountant) if you are trying to straighten out overdue taxes. Often an effort to make an IRS payment plan might satisfy Immigration.

5. Lying Even if an innocent mistake is made on the application, the individual will most likely be denied citizenship. This commonly happens with questions involving the applicant’s criminal history. Since they were not convicted they might check the “NO” box when asked about being arrested, and that could be viewed as potential fraud.

6. Child support Very similar to the delinquent taxpayer, one who fails to make timely child support payments could find himself staring at a denial of his N-400.

7. Failing the English Test Applicants do not need to have complete mastery over the English language, but it is vital that they know the basics and can have simple conversations. People who are over the age of 55 who have been in the country with a green card for over 15 years are exempt from this rule.

Request for Hearing after N-400 Denial If USCIS determines you need to provide additional documents or evidence, you may be given Form N-14, Request for Additional Information, Documents or Forms. You will need to provide the additional documentation requested to continue the naturalization process. If your N-400 was denied, you may request a hearing with a USCIS officer. Your denial letter will explain how to request a hearing and will include the form you need. The form for filing an appeal is the N-336, Request for Hearing on a Decision in Naturalization Proceedings. You must file the form with USCIS, including the correct fee, within 30 days after you receive a denial letter.
