3 Separate Issues Taking a complete company out of the market Interrupting a Retail Customer for days without making any type of arrangements ERCOT suggesting to use Force Majeure for planned outages

No Changes to Customer Service In the past, weeks were spent developing switching procedures that minimized the impact to the Retail Customer. Nothing, in this new market, has changed to force us to give up on the Principle of customer service.

Protocols are Unclear ERCOT, in previous verbal discussions, indicated that OOME would be used to settle the Generator. In order to avoid a settlement dispute, it was requested that ERCOT provide their interpretation of the ERCOT Protocols in writing prior to the outage. At this point, ERCOT indicated that the Protocols were not clear as to their ability to issue an OOME instruction.

Protocol Clarification For Resource Entities that have dual interconnection paths onto the ERCOT Transmission Grid, efforts shall be taken in the performance of Maintenance Outages to prevent interruption of both interconnections at the same time. If such an outage is unavoidable, the TSP shall, if needed, arrange for required station service and the Resource Entity shall be paid the OOME Down rate for any deliveries of energy prevented by the outage up to a maximum limit of 50% of the Resource Entities capacity ratings.
