International Accident Investigation
General International aviation accident and incident investigations are governed by the provisions of Annex 13 to the Convention on International Civil Aviation, referred to as the “Chicago Convention”
General The Chicago Convention is administered by the International Civil Aviation Organization (ICAO) located in Montreal, Canada
General Annex 13, Aircraft Accident and Incident Investigation, contains the standards and recommended practices to be followed by all ICAO-Member States for notifications, investigations, and reporting of accidents and serious incidents
Responsibilities State of Occurrence shall: Notify the States of Registry, Operator, Design, Manufacture, and ICAO about the occurrence of accidents and serious incidents
Responsibilities Institute and conduct the investigation, or delegate all or part of it to the states of registry, operator, design, or manufacture
Responsibilities Complete a draft final report of the investigation Solicit comments on the final draft report from participating states Publish a Final Report
Responsibilities Direct safety recommendations to the investigative authorities of interested states -any time in the process
Responsibilities State of Registry shall institute and conduct the necessary investigation of accidents and serious incidents for which the location is outside the territory of any state (international waters – or missing aircraft)
Responsibilities – Participating States States of Registry, Operator, Design, and Manufacture shall: Provide relevant information to State of Occurrence, upon request Inform the State of Occurrence of intent to participate in investigation and name an accredited representative
U.S. Investigations--NTSB Policies and Practices Consider the “foreign interests” ……. if a non-U.S. registered, operated, designed, or manufactured aircraft is involved in an accident in the U.S.:
U.S. Investigations--NTSB Policies and Practices Have full access to relevant evidence Receive copies of pertinent documents
U.S. Investigations--NTSB Policies and Practices Participate in readout of recorders Participate in follow up of activities
U.S. Investigations--NTSB Policies and Practices Participate in progress meetings Make submissions to the NTSB regarding conclusions, recommendations, and causes in lieu of participation in the analysis process-- (note: accredited representatives and advisors cannot participate in the NTSB’s analysis)
Final Report Under the Provisions of Annex 13: Draft Final Report is subject to review and comment by the Accredited Representative from the all participating states
Final Report Comments are accepted for 60 days Report shall be amended to reflect comments of the states, or the comments are appended to the Final Report
Safety Recommendations Safety Recommendations developed by the NTSB that pertain to another state’s airline or products are coordinated with the respective states’ accredited representatives before publication
NTSB Participation Outside the US As the state of the operator As the state of design or the state of manufacture Or the state of registration
NTSB Participation Outside the US NTSB will designate a U.S. Accredited Representative Appoint Advisors (an advisor team) to function under the supervision of the Accredited Representative that may or may not travel to the scene (based on the event circumstances)
NTSB Participation Outside the US NTSB participates under the control of the foreign investigation authority per Annex 13 – this participation includes: Field investigation, off site examination and testing, (simulations and examinations may take place in the US)
NTSB Participation Outside the US Consultation on the draft Final Report Creation of recommendations and action to preclude accident recurrence
