STOP AND FRISK LAWS IN SOUTHERN STATES BY ERIN HUGHES, SOPHIA GUIDO AND AMANDA FATOVIC

STOP AND FRISK STOP AND FRISK HAPPENS WHEN A POLICEMAN IS SUSPICIOUS OF AN INDIVIDUAL AND HAS THE RIGHT TO SEARCH THE INDIVIDUAL FOR WEAPONS, DANGEROUS ITEMS ETC.

STOP AND FRISK FOR LATINOS IMMIGRATION AND CUSTOMS ENFORCEMENT (ICE) HAVE USED STOP AND FRISK LAWS TO CHECK STATUS OF LATINOS MOBILE FINGERPRINTS UNITS ARE USED TO DETERMINE WHETHER LATINOS HAVE COMMITTED A CRIME OR NOT NOT ALL ILLEGAL IMMIGRANTS THAT ARE DEPORTED COMMIT A CRIME

SOUTHERN STATES AFFECTED BY STOP AND FRISK IN 2010, ARIZONA PASSED THE FIRST LAW REQUIRING DOCUMENTATION BEING CARRIED AT ALL TIMES. FIVE OTHER STATES HAVE ENACTED ARIZONA STYLE LAWS INCLUDING ALABAMA, GEORGIA, SOUTH CAROLINA, UTAH, AND INDIANA. POLICE HAVE POWER TO QUESTION AND FRISK THE PERSON WHO THEY DEEM SUSPICIOUS OF BEING AN ILLEGAL IMMIGRANT.

IMMIGRATION LAWS BY STATE Passed Arizona style legislation Serious threat to enact Arizona style legislation Flirted with Arizona style legislation; no traction No Arizona style legislation

STATISTICS OF IMMIGRATION OVER HALF OF THE BORDER CROSSINGS IN THE US OCCUR ON THE ARIZONA AND MEXICO BORDER. BETWEEN 1996 AND 2009, THE ILLEGAL ALIEN POPULATION INCREASED BY 300% ILLEGAL IMMIGRATION HAS COST ARIZONA OVER 2 BILLION DOLLARS A YEAR IN EDUCATION, MEDICAL BENEFITS AND CRIMINAL PROSECUTION

CRIME RELATED TO ILLEGAL IMMIGRATION CRIMINAL GANGS SUCH AS MS-13 ARE DRAWN TO ARIZONA FOR DRUG TRAFFICKING AND HUMAN SMUGGLING. PHOENIX, ARIZONA HAS THE SECOND HIGHEST KIDNAPPING RATE IN THE WORLD BEHIND MEXICO CITY 2008 SAW 386 KIDNAPPING AND 337 HOME INVASIONS IN ARIZONA, A 61% INCREASE SINCE 2005.

GOVERNMENT ACCOUNTABILITY OFFICE IN 2005, INVESTIGATION OF 55,000 ILLEGAL ALIEN CRIMINAL RECORDS SHOWED: 45% WERE ARRESTED FOR DRUGS OR IMMIGRATION OFFENSES 15% WERE FOR BURGLARY OR THEFT 12% FOR MURDER, ROBBERY, AND ASSAULT

CONTROVERSY  NOT EVERYONE BELIEVES THAT STOP AND FRISK ACTUALLY REDUCES CRIME  THEY CAN BE PROVEN TO EMPHASIZE RACISM BY FRISKING SOMEONE WHO LOOKS “SUSPICIOUS” BECAUSE THEY ARE MEXICAN AND MAY RESEMBLE SOMEONE WHO MAY HAVE COME TO AMERICAN ILLEGALLY  MAIN IDEA: SPECIFIC RACES ARE UNFAIRLY TARGETED DUE TO STEREOTYPES

CONTROVERSY CONTINUED  THE US COMMITTED TO REMOVING ILLEGAL IMMIGRANTS WHILE ALSO TRYING TO FOLLOW ITS COMMITMENT TO RACE NEUTRALITY  HOWEVER, IMMIGRATION ENFORCEMENT HAS DISPROPORTIONATELY TARGETED MEXICANS AND CENTRAL AMERICANS  THE CURRENT MIX OF FEDERAL AND LOCAL ENFORCEMENT DISCRIMINATES RACIALLY THROUGH THINGS SUCH AS PROFILING, HYPER-SURVEILLANCE, ABUSIVE STOPS, PROBLEMATIC SEARCHES AND UNWARRANTED DETENTION

CONTROVERSY OF ARIZONA  ARIZONA HAS BEEN KNOWN FOR ITS STRONG NATIVIST AND ANTI-IMMIGRANT CLIMATE  HOWEVER, ITS LEGISLATION AND POLICING PRACTICES ARE IN VIOLATION OF CIVIL AND HUMAN RIGHTS  LEGISLATION, RAIDS AND LOCAL IMMIGRATION ENFORCEMENT TACTICS REINFORCE THE DOMINANT GROUPS (WHITES) FEAR OF THE OTHER RESULTING IN MICRO AND MACRO AGGRESSIONS THAT LEGITIMIZE RACIAL PROFILING AND HELP SAFEGUARD AND FORTIFY WHITE PRIVILEGE THOUGH THE FABRICATION OF RACIALIZED IDENTITIES.

IMMIGRATION · GOV. JAN BREWER OF ARIZONA SIGNED THE NATION’S TOUGHEST BILL ON ILLEGAL IMMIGRATION INTO LAW ON FRIDAY. ITS AIM IS TO IDENTIFY, PROSECUTE AND DEPORT ILLEGAL IMMIGRANTS. · CARDINAL ROGER M. MAHONY OF LOS ANGELES SAID THE AUTHORITIES’ ABILITY TO DEMAND DOCUMENTS WAS LIKE “NAZISM.”

IMMIGRATION CONTINUED · THIS LAW CAN BE CONSIDERED THE BROADEST AND STRICTEST IMMIGRATION MEASURE IN GENERATIONS · THE FAILURE TO CARRY IMMIGRATION DOCUMENTS A CRIME AND GIVE THE POLICE BROAD POWER TO DETAIN ANYONE SUSPECTED OF BEING IN THE COUNTRY ILLEGALLY

IMMIGRATION THIS LAW IS AN OPEN INVITATION FOR HARASSMENT AND DISCRIMINATION AGAINST HISPANICS REGARDLESS OF THEIR CITIZENSHIP STATUS.
