Current legal framework Public health rules Regulation (EC) No 178/2002 Regulation (EC) No 852/2004 (Regulation (EC) No 853/2004)  For CP see –Article 1 –Article 6 (4), but derogation in Article 3 (2) Regulation (EC) No 1162/2009 applies until 31 st December 2013

Definition for “Composite Products” e. g. Production of Lasagne AH rules: Article 2 (a) Decision 2007/275/EC PH rules: Article 1 Regulation (EC) No 853/2004  With Bolognese sauce (processed product)  establishment needs no approval in accordance with PH rules  Production of Bolognese sauce (using unprocessed minced meat) is an integral part of the production of Lasagne  approval is necessary in accordance with PH rules

New Regulation for CP applicable from 1st January 2012 Commission Regulation laying down requirements for the certification for imports into and transit through the Union of certain composite products and amending Decision 2007/275/EC and Regulation (EC) No 1162/2009

Step 1: Harmonised import requirements for certain CP  Which CP are involved? CP containing –Processed meat products, as referred to in Article 4 (a) of Decision 2007/275/EC, –Processed milk products and covered by Article 4(b) and (c) of Decision 2007/275/EC, –Half or more of their substance of processed fishery or egg products and covered by Article 4 (b) of Decision 2007/275/EC

Step 1: Harmonised import requirements for certain CP  Requirements:  TC of production of the products of animal origin must appear on the EU-list  Products of animal origin must come from establishments in compliance with Article 6 (1) (b) Reg. (EC) No 853/2004

Step 1: Harmonised import requirements for certain CP  New model health certificate for CP  Specific PH requirements for the production of the products of animal origin  Production of CP in accordance with the general PH requirements, in particular HACCP (Article 5 Reg. (EC) No 852/2004)  TC of origin of the meat or dairy products being part of the CP must be the same as the country of export of the CP  AH requirements for the production of the meat or dairy products

Step 1: Harmonised import requirements for certain CP  Consequences of the new model health certificate: Article 5 of Decision 2007/275/EC is deleted Transitional period until 31st May 2012 for the previous certificates in accordance with Article 5 of Decision 2007/275/EC

What about CP containing products of animal origin other than those referred to in step 1? e.g.: Different sorts of nuts “pickled” in honey

Which CP are involved? –CP containing half or more of their substance of products of animal origin other than those referred to in step 1 (see Article 3 (3) of the new Regulation) –e. g.: CP containing honey / gelatine / collagen Transitional period in Article 3 (2) first subparagraph of Regulation (EC) No 1162/2009 is still in force until 31st December 2013 for these CP These CP will be regulated in Step 2.

Step 2: Further import requirements for certain CP containing products of animal origin other than those referred to in step 1 Starting after the transitional period ??? TC of production of the products of animal origin must appear on the EU-list No common harmonised model health certificate for import of these CP – Commission is working on AH conditions Relevant model health certificate of the product of animal origin being part of the CP or a commercial document

Harmonised transit rules for certain CP  Which CP are involved? –CP containing meat or dairy products (see Article 3 (1) (a) and (b) of new Regulation) –CP not intended for EU but destined for TC by immediate transit or transit after storage

Harmonised transit rules for certain CP  Requirements: TC of production of the meat or dairy products must appear on the EU-list Meat and dairy products must comply with the appropriate treatment conditions (Dec. 2007/777/EC and Reg. 605/2010) Positive result for transit (including storage) on the CVED

Harmonised transit rules New model health certificate for transit of CP  TC of origin of the meat or dairy products being part of the CP must be the same as the country of export of the CP  Must fulfil specific AH requirements for importation of meat and dairy products

Derogations for transit from or to Russia:  Which CP are involved? –CP referred to Article 3 of the new regulation (containing meat or dairy products or half or more of their substance of other products of animal origin) –Transit by road or rail between BIPs in LV, LT,PL  Requirements: –Consignment sealed at BIP –Accompanied by the original veterinary documents, stamped “ONLY FOR TRANSIT TO RUSSIA VIA THE EU” –Comply with the procedural requirements for transit –Positive result for transit on the CVED –No unloading or storage

Conclusions and preview Regulation is the result of controversial discussions over years Implementation of step 2 after the end of the transitional period (after ) SANCO will monitor implementation and if problematic areas occur which need to be addressed
