Criminalization of Abortion in 3 LAC countries By Beatriz Galli, Washington D.C April 2016

Implications of abortion criminalization 22 million abortions estimated 47,000 women die 5 million more suffer disability annually Unsafe abortion accounts for approximately 13% of global maternal deaths

Human rights violations in Brazil, Argentina and Bolivia

Ipas report: when abortion is a crime The case of Helena in Bolivia

Criminal laws discriminate against women and adolescent girls Rio de Janeiro State, Brazil: 20.2% prosecuted for abortion were adolescents.

Findings: Rio de Janeiro State, Brazil 2007–2011 Police reports: 334 Court records: 128 women prosecuted.

Findings: Bolivia and Argentina Bolivia, 2008–2012: 775 court cases. Argentina, : 417 sentences against unskilled individuals providing services. Criminalization is rare: unsafe abortion is high When laws are enforced it is discriminatory targeting the most vulnerable women in society.

Recommendations Governments should: Decriminalize abortion; Protect the right to privacy and confidentiality for women seeking post-abortion care; Develop health provider guidelines and policies to protect patient confidentiality and safeguard medical records Develop policies to protect women, girls and providers from arrest or prosecution.
