1 scenario

DV  a big umbrella covering family violence (marital, intergenerational) and gender violence crimes  complexes and polymorphic aggressors and victims are not all alike  socially transversal: crosses all ages and social classes  universal

framework  DGRSP – national probation and prison service /MoJ EM services policy  sharing the probation service's strategy, culture and know how  oriented to be an alternative to incarceration  closeness to the offenders  public service full responsibility in running EM operations happy and proud of it  private sector provide only EM and logistics tasks

03 EM CENTRAL UNIT 04> structure  10 EM territorial units  1 EM central unit for security, supervision and redundancy each unit  responsible for the enforcement in its territory  autonomy but under the same national protocols  case management = EM +probation work install and uninstall equipment  connection with the stakeholders courts, community, family, public and private services, NGO, the police, …  reporting to the courts EM dept

DV legal framework  home confinement (-)  restraint orders (+) pre-trail 1.coercion measure after trial 2.suspended sentence with a restraint order 3.restraint order as an additionnel sentence

DV restraint orders | case load and breaches  almost 500 cases daily basis  80% pre-trial  20% sanctions  tend to grow, albeit slow breaches revocation rate2,16%2,83%

EM technology what for? tool  to increase the level of control over the offenders  to restrain aggressive behaviours   to enhance victims protection

consent  important as a symbolic contract  consent means cooperation, cooperation is critical for EM!  DV restraint orders: victim and offender consent required … but the offender´s may be disregarded/surpassed by the judge decision always up to the judge!  when it comes to deciding on the imposition of restrictions to freedom and custodial measures, it is crucial to have an independent judge  probation advises previously the court

2 operations

restraint orders eligibility  no legal criteria, is just up to the judge and his personal assessment  the law predicts a previous probation report to courts to assess offender conditions  in some cases, probation units use SARA Spousal Assault Risk Assessment we advocate  medium risk  EM  medium/high risk  house arrest with EM  high risk  prison  low risk  other legal solutions

technologies EM dept. does not choose technologies, it comes in the law RF for home confinement (pre-trial, sanctions) GPS for all kinds of DV restraint orders (since 2012)  2 pieces GPS + victim device  exclusion zones for the offender  land exclusion zones for several victims - home, working places, schools..., circle or polygonal  mobile exclusion zone around the victim for 1 victim

alarms victim  alarms in her own GPS machine  approach offender-victim in mobile exclusion zones regardless of who approaches whom  allows victim to immediately develop her own personal safety strategy offender  alarms in his own GPS machine  violation of land exclusion zones  only if the offender is aware of where the victim lives or works

EM units  got them all … and more  must manage a tremendous amount of data!  violation of land and dynamic exclusion zones  approaches offender-victim in mobile exclusion zones, regardless of who approaches whom  loss of telecommunications and GPS signal  loss connection between bracelet and GPS machines  among many others

intervention – the best practice  EM managed in the best way possible – rigor, carefully…  the importance of creating bonds with the offender and to establish a relationship with him  in sanctions, VERY USEFUL to combine EM with programs – criminal behavior change, alcohol, drugs….  our business is the offender; victims are oriented the victim support bodies

incidents - response  EM services management  the police is demanded just when serious violation occur or when the safety victim is under threat  prudence many alarms are generated by the two parties overlapping routines  extremely careful not spending police resources  stress and risk are always part of the management actions in responding to incidents

3 17 considerations

1.problematic of DV is more complex than the public speaking about it 2.implementing the control of DV with EM is based on the understanding  of the offender behaviour +  the relationship between the parts ambiguities, badly made ruptures and bereavements, routines, dependencies … some considerations learned from our experience

5.judicial decisions doesn't take in account the level of risk is a dynamic variable very clear with mental disorders or addictions 6.the prolonged use of this mode of control becomes counterproductive, penalizing the victim and the offender even complicating the mourning process by keeping them "artificially linked together” 7.EM should be a short term intervention (up to 1 year); long term interventions are counterproductive, saturating, perverse and expensive

8.vocation for medium risk cases 9.EM and probation work  pre-trial social approach is also important to avoid a cold control  sanctions, behavioral /cognitive programs matters; EM should be complementary to add muscle to the control

impact in many cases 10.victims effective feeling of security allowing them, for the first time, take over their life and routines 11.offenders it is the first real sign that they have to change their behavior when confronted with a measure that limits their life (in many cases significantly) and that brings awareness of the need to distance themselves from the victim and the relationship and interrupting the cycle of violence working with some offender strategies to help them to begin the emotional mourn to the victim

12.victims and offenders EM often provides the first moment when both perceive the gravity of the situation in which they lived, allowing them to question themselves about the relational mismatch between both 13.courts good reaction to EM, but they have difficulties to understand how does it work and that is a very intrusive tool 14.data and proof EM deliver solid information on breaches and violations, useful in court

15. GPS data protection  enormous amount of data from 2 persons  need to cooperate with the police and the public prosecutor office  but data for new criminal investigation must be demanded by the judge

16. some more sensitive managing difficulties EM system  enormous amount of data from the involved 2 persons!  lost of GPS signal  certain fragility of the GPS machines behaviors  the victims with ambiguous behavior  when the victim approaches the offender voluntary or involuntary  when the offender approaches the victim involuntary staff  facing so many variables in the table  difficult to decide, even when the protocol says offender must live

GPS and burn out 17.GPS deliver a lot of information, behavior indicators needed to be read and interpreted very carefully exhaustive work and staff burnout

4 conclusions

DOES ELECTRONIC MONITORING FIT IN THE APPROACH TOWARDS DOMESTIC VIOLENCE? yes, if some cautions are taken, mainly  good technology  good protocols and procedures  adequate eligibility: medium risk, not more, not less  permanent assessment and the possibility of changing the terms of the decision good  to combine EM with other interventions (in sanctions)  to pay attention to staff burn out  to pay attention to data protection
