Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 6 What is Public Law ? Public Law is the Indian Employment, Training, and Related Services Demonstration Act that was signed into law by President George H. W. Bush in 1992.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 7 PL was enacted to: Demonstrate how Indian tribal governments can integrate the employment, training, and related services they provide in order to improve the effectiveness of those services; Reduce joblessness in Indian Country; and Serve Tribally-determined goals that are consistent with the policies of self-determination.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 8 P.L and CSBG PL consolidated plans - often referred to as “477 Plans” are submitted to and administered by the Department of Interior (DOI), Bureau of Indian Affairs (BIA) CSBG, with its aims of self-sufficiency and moving families off of public assistance and its explicit authorization of funds to be used for employment and training activities, can be understood to support the employment- oriented purposes of the 477 Act Participation is limited to federally-recognized Tribes and Tribal Organizations Participation in P.L is voluntary

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 10 To include CSBG in a P.L Demonstration Project, a Tribe or Tribal Organization: Must be Federally-recognized with an existing direct Federal CSBG grant in operation for at least one (1) year. Must have at least two (2) programs eligible for incorporation into P.L Must be able to show a proven record of financial responsibility, demonstrated by three years of recent “clean” audits.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 11 Criteria (continued) Prior to submitting an application, Tribal CSBG Program Directors should contact the Division of State Assistance and confirm that minimum criteria are met.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 12 Waivers: All applicable CSBG program statute, regulations, and policy continue to apply (unless ACF grants a waiver) to CSBG funds approved to be included in a P.L demonstration project. Tribes do have the right to requests waivers as long as the waiver is consistent with the purpose of P.L or with provisions of the CSBG Act. Waiver requests may be submitted as a part of the Tribe’s plan

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 14 If you elect to participate in a demonstration pilot in FY 2017, you must submit your plan no later than July 1, Plan applications may be submitted at any time during the fiscal year. Please note that, because CSBG is administered on an annual basis, if an application is submitted after January 1 st of a given fiscal year, it will not become effective until the CSBG Plan is accepted and funds are made available in the next available fiscal year.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program Plan Submission An additional copy should also be sent via to: Office of Community Services Division of State Assistance Attn: CSBG Program Operations Branch After an initial review by BIA, plans will be forwarded to OCS for final review and acceptance. The entire plan review process must be completed within 90 days of receipt.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 18 What to Expect OCS will either accept the plan, or return the plan to BIA if additional information or clarification is needed. Be sure to do a thorough review of your plan. Applicants that do not meet the minimum criteria will not be reviewed. OCS will provide BIA with an explanation.

If an applicant elects to include CSBG in a consolidated Plan, the following CSBG requirements must be included.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 23 Application Content: Letter of Intent This is a brief statement of intent to administer the CSBG under a P.L Plan. DSA has created a simple template for applicants to use.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 25 Application Content: Programmatic Assurances | Sign & Certify Submitted CSBG Plans should include specific programmatic assurances that are both signed with an original signature and certified by the Tribe or Tribal Organization’s CEO.

Other administrative certifications

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 27 Application Content: Original Signatures and/or Delegation of Authority The assurances must contain original signatures of the CEO, Tribal Chief or an authorized designee. If the CEO has delegated this responsibility, a written and signed confirmation of such a delegation by the CEO must be included with the application.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 29 Application Content: CSBG Narrative Provide a description of how the assurance(s) will be carried out and how the organization will comply with the certifications Outline the goals and objectives of the Tribal organization to administer the Community Services Block Grant including the Tribe’s strategy to identify the employment opportunities, education, training and related services to be provided to Indian workers Describe the planned distribution of funds for the fiscal year(s ).

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 30 Application Content: Public Hearing Documentation Describe how, when and where the Tribe or Tribal Organization made the Plan available for review and comment prior to plan submission Supporting documentation may include: o The public hearing announcement; o Meeting agenda; o List or Registry of attendees; and o Copies of any comments provided

Must be current and up to date. Gives a Tribal organization, by resolution, authority to seek funding for identified Tribes. Include copies of resolutions in your Plan.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 33 Application Content: Annual Reporting Requirements The CSBG Annual Report must include narrative that addresses each of the following: o Accounting on how funds were spent on the direct delivery of local services; o Information on the number of and characteristics of clients served; o How the grantee met its goals and objectives; o Information on the types of projects supported by CSBG funds; o Accomplishments of projects and activities; and o Outcome data that addresses the implementation of the national goals.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 35 Application Content: Annual Reporting Requirements (2 Year Accepted CSBG Plan) Tribes or Tribal Organizations that: 1) have previously submitted a two year CSBG plan; 2) are currently in the first year of an accepted CSBG two-year plan cycle; AND 3) are transitioning to the P.L , will only be required to submit a Letter of Intent, an Annual Report and the SF-424M to BIA.

Recognizing that the fiscal year ends after the submission of the application, utilize the most current available data for the current fiscal year.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 38 Withdrawal Steps Tribes participating in plans may withdraw at any time. To do so: –The Tribal Chief, Chair or CEO must submit a letter to the “477” Lead Agency at DOI, with a copy to OCS. –The letter must state that the Tribe is withdrawing its CSBG funds from its existing Plan and specify the approved Plan period. –Withdrawals will become effective at the beginning of the following fiscal year. Note: The CSBG Fiscal Year begins October 1 of a given year and ends on September 30 of the following year.

Office of Community Services Division of State Assistance CSBG Tribal Technical Assistance Program 39 Re-Submission Steps The Tribal Chief, Chairman or CEO must submit a letter to OCS requesting re-submission, along with a completed CSBG application and Plan for the requested fiscal year no later than 30 days prior to the beginning of the first fiscal year covered by the plan.
