Access Limited Use Conditions These land uses have the Access Limited Use condition:  Agricultural Support - LI, HI  Auto Service/Fueling or Charging Station – C, CB, RES/REC, LI  Commercial Amusement /Recreation, Outdoor - TN, C, CB, RES/REC  Heavy Industry – HI  Heavy Vehicle, Manufactured Home Sales Watercraft, or Aircraft Sales or Rental - RES/REC, LI, HI  Homeless Shelter – C, CB, RES/REC  Light Industry - LI, HI  Nursery Wholesale - C  Passenger Motor Vehicle Sales or Rental - C, CB  Retail – Big Box - TN, C, RES/REC, LI, HI Access: The site shall have frontage on and take access from a street classified as an collector, arterial or Highway. The Second Limited Use Revision This revision is regarding two limited use conditions that are found together in four land uses. Together they are contradicting and confusing. Staff is recommending eliminating one.

Commercial Amusement /Recreation, Outdoor: Eliminate Minimum Distance from Residential The use shall be located at least 200 feet from any residential use or residential zoning district boundary, measured as a radius from property lines of the limited use. Proposed to Remain Hours of Operation near Residential. The use, if within 200 feet of the property line of a residential use, a mixed-use development that includes residential use, or a residential zoning district boundary, measured as a radius from property lines of the limited use, shall not operate between the hours of 12:00 am and 8:00 am.

Flea Market Eliminate From Residential Use Except in the CB districts, a flea market shall be a minimum of 200 feet from any residential use or residential zoning district boundary, measured as a radius from property lines of the limited use. Proposed to Remain Hours of Operation near Residential Except in the CB district, the use, if within 200 feet of a residential use or a residential zoning district boundary, measured as a radius from property lines of the limited use, shall not operate between the hours of 9:00 PM and 9:00 AM. Hours of Operation if Outdoor The limitation on hours of operation above shall be between the hours of 7:00 PM and 9:00 AM for an outdoor flea market.

Light Industry: Eliminate Hours of Operation near Residential The use, if within 200 feet of the property line of a residential use, a mixed-use development that includes residential use, or a residential zoning district boundary, measured as a radius from property lines of the limited use, shall not operate between the hours of 12:00 am and 8:00 am. Proposed to Remain Minimum Distance from Residential. From Existing Residential Dwellings: 200 feet from any residential dwelling in existence at the time the use receives limited use approval, measured as a radius from property lines of the limited use. From Residential Districts: 200 feet from any residential zoning district boundary, measured as a radius from property lines of the limited use.

Retail Lending Facility: Eliminate Hours of Operation Near Residential The use, if within 200 feet of the property line of a residential use, a mixed-use development that includes residential use, or a residential zoning district boundary, measured as a radius from property lines of the limited use, shall not operate between the hours of 12:00 am and 8:00 am. Proposed to Remain Minimum Distance from Residential District The use shall be located at least 200 feet from a residential zoning district boundary, measured as a radius from property lines of the limited use, unless separated from the district by an arterial street.
