Measure S Language Section 5. Conflict with other Initiatives This Initiative is intended to fully conflict with the so-called “Stockton Greenbelt and Agricultural Lands Protection Initiative.” In the event both initiatives are approved by the voters this Initiative shall take precedent over the other initiative and the other initiative shall be of no force or effect.

Elections Code and Charter Language  Elections Code section 9221: “If the provisions of two or more ordinances adopted at the same election conflict, the ordinance receiving the highest number of affirmative votes shall control.”  Charter Article IX, section 904: If the provisions of two (2) or more measures approved or adopted at the same election conflict, then the measure receiving the highest affirmative vote shall control.

SUMMARY It is recommended that the City Council: 1. Adopt a resolution declaring the results of the November 2, 2004 Election as certified by the Registrar of Voters; 2. Adopt the ordinance as approved by the voters as a result of Measure S (Agricultural Protection Ordinance Measure); 3. Adopt a resolution invalidating Measure Q (Urban Growth Boundary Measure); 4. Adopt the ordinance as approved by the voters as a result of Measure X (Southeast Stockton Urban Growth Boundary Measure); and 5. Adopt the ordinance as approved by the voters as a result of Measure W (Stockton Safe Neighborhood Gang and Drug Prevention, Police/Fire Response Measure).
