The aim of this Recommendation is to foster the development of the single market by enhancing legal certainty and promoting investment, competition and innovation in the market of for broadband services in particular in the transition to next generation access networks (NGA)

WHY DO WE NEED THE RECOMMENDATION 2010/572/EU Broadband – topic Number One To stimulate the transition from copper to fibre- based network according to Directive 2002/21/EC Article 16(4) To promote efficient investments by all operators To reduce the civil engineering infrastructure costs To ensure the effectiveness of access to fibre lines, terminating segments and ducting

THE STRUCTURE OF NGA RECOMMENDATION There are 4 most important points: A. Unbundled access to optical local loop B. Access to the ducting system C. Access to the terminating segments D. Creating, support and access to the information system (publishing the information, data bases and/or mapping)

HOW DO WE KNOW THE OPERATORS’ NEEDS ? There are many different opinions between operators how to implement basic points of the NGA Recommendation Ask the operators about possible practical solutions to be developed – create and distribute questionnaire or arrange public consultation

POSSIBLE QUESTIONS Part A – LLU (1) Q1. Is it necessary for you to apply for the unbundled access to optical local loop (LLU)? Q2. Do you use the LLU now? Q3. What type of LLU technical solutions meets your requirements? Q4. Do you have your own fibre network now? Q5. Did another operator ask you to provide him LLU in your network as a service? Q6. Do you provide LLU in your network as a service now? Q7. What type of LLU technical solutions do you provide now?

POSSIBLE QUESTIONS Part A – LLU (2) Q8. Do you need the regulation from NRA for LLU? Q9. Do you need the regulation for the dispute resolution? Q10. Do you need the technical regulation and regulation for procedures? Q11. Do you need the tariff regulation? Q12. Do you think that only SMP operator has to be obliged to provide LLU as a service (asymmetrical regulation)? Q13. Do you think that every operator, who has an fibre based network, has to be obliged to provide LLU as a service (symmetrical regulation)?

POSSIBLE QUESTIONS Part B – Ducting (1) Q1. Is it necessary for you to apply for the access to ducts belonging to another operator to provide your own fibre network? Q2. Do you use ducts belonging to another operator now? Q3. Do you have your own ducts? Q4. Did another operator ask you to provide him access to your ducts as a service? Q5. Do you provide the access to your ducts as a service to another operator now?

POSSIBLE QUESTIONS Part B – Ducting (2) Q6. Do you need the regulation from NRA for the access to ducts? Q7. Do you need the regulation for the dispute resolution? Q8. Do you need the technical regulation and regulation for procedures? Q9. Do you need the tariff regulation? Q10. Q2. Do you use terminating segment, belonging to another operator, now? Q3. Do you have your own terminating segments? Q4. Did another operator ask you to provide him access to your terminating segment as a service? Q5. Do you provide the access to your terminating segment as a service to another operator now?

POSSIBLE QUESTIONS Part C – Terminating Segment (2) Q6. Do you need the regulation from NRA for access to the terminating segment? Q7. Do you need the regulation for the dispute resolution? Q8. Do you need the technical regulation and regulation for procedures? Q9. Do you need the tariff regulation? Q10. POSSIBLE QUESTIONS Part D – Information System (1) Q1. Do you need the information system or/and data base or/and electronic maps etc. with the information related to NGA? Q2. What kind of information has to be placed in such system: a. Geographical information about fibre optics cables (owner, type and capacity of cable, route, etc.)? b. Geographical information about ducts (owner, diameter of duct, free capacity, route, etc.)? c. Geographical information about the terminating segment (owner, type and capacity, route, etc.)? d. Information about planned civil engineering construction works (responsible person, place, type of construction)?

POSSIBLE QUESTIONS Part D – Information System (2) Q3. Who has to be responsible for such information system: a. Every operator for his own system? b. SMP operator? c. All operators designed and supported common database? d. NRA? e. Municipalities? d. Combination of mentioned above? Q4. Does the access to such information system should be opened for everybody or operators only or some another security limitations should be implemented? Q5. Does the access to such information system have to be free of charge?

CONCLUSION IT IS NOT EASY TO MAKE A DECISION ABOUT THE SOLUTIONS FOR ALL NGA PROBLEMS IT IS NOT POSSIBLE TO SOLVE ALL THE PROBLEMS DURING THE SHORT PERIOD OF TIME, BUT IT IS NECESSARY TO START FROM SOMETHING ASK MARKET PLAYERS ABOUT THEIR VIEW ON THE NGA PROBLEM, ANALYZE ANSWERS AND OPINIONS AND DECISION MAKING PROCESS WILL BE EASER, MAY BE…
