CONSULTATIVE WORKSHOP ON PORT CONGESTION IN THE PMAESA REGION 25 – 26 SEPT,2008 MOMBASA-KENYA THE ROLE OF SUMATRA IN REDUCING PORT CONGESTION IN DAR-ES-SALAAM PORT, TANZANIA

INTRODUCTION Surface and Marine Transport Regulatory Authority ( SUMATRA) is a Multi-Sectoral regulatory agency SUMATRA was established by Tanzania Act of Parliament No.9 of 2001 to regulate –Rail –Road and –Maritime transport services.

SUMATRA VISION To be an effective regulatory body dedicated to the pursuit of competitiveness, efficiency, economy and safe transport services in the Surface and Marine Transport Sub-sectors.

SUMATRA MISSION To promote, facilitate, and ensure availability of efficient, safe, fair, reliable and environmentally friendly transportation services in the Surface and Marine transport sub-sectors through competition, fair trade practices and provision of requisite information to stakeholders

ROLE OF SUMATRA The SUMATRA Act,2001, sets out the following as the role of the Authority ; -Promoting effective competition and economic efficiency. -Protecting the interests of consumers. -Protecting the financial viability of efficient suppliers. -Promoting the availability of regulated services to all consumers including low income, rural and disadvantaged consumers.

ROLE OF SUMATRA (cont.) -Enhancing public knowledge, awareness and understanding of the regulated sectors including as to; The rights and obligations of consumers and regulated suppliers. The ways in which complaints and disputes may be initiated and resolved. The duties and functions of the Authority. - Taking into account the need to protect and preserve the environment.

FUNCTIONS OF SUMATRA The functions of SUMATRA include the following; a)to perform the functions conferred on the Authority (SUMATRA) by sector legislation. b)subject to sector legislation; (i)to issue, renew and cancel licences. (ii)to establish standards for regulated goods and regulated services. (iii)to establish standards for the terms and conditions of supply of the regulated goods and services. (iv)to regulate rates and charges. (v)to make rules.

FUNCTIONS OF SUMATRA (cont) c)to monitor the performance of the regulated sectors, including in relation to; i.levels of investment. ii.availability,quality and standards of services. iii.the cost of services. iv.the efficiency of production and distribution of services. v.other matters relevant to the Authority.

FUNCTIONS OF SUMATRA (cont) d)to facilitate the resolution of complaints and disputes. e)to disseminate information about matters relevant to the functions of the Authority. f)to consult with other regulatory authorities or bodies or institutions discharging functions similar to those of the Authority in Tanzania or elsewhere.

SECTOR SCOPE SUMATRA’S Sectoral scope covers, -Rail transport -Port and Shipping services -Maritime Safety and Security -Road transport -Economic regulation.

SECTOR LEGISLATION SUMATRA’S regulatory powers are vested in the following sector legislation; i.The Shipping Agency Act,2002. ii.The Ports Act,2004. iii.The Transport and Licencing Act,1973. iv.The Merchant Shipping Act,2003. v.The TCFB Act,1981. vi.The Railways Act,2002.

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION SUMATRA as a regulatory body in Ports and Shipping services has continued to consult with Key Stakeholders involved in Port operations and cargo clearance from the port in overcoming port congestion in Dar-es-Salaam port.

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION The following are areas that SUMATRA continue to monitor and advise Key Stakeholders; a)Port Operators to have adequate cargo handling equipment in the port to cope with increasing volumes of cargo. b)Port Operators to have proper port equipment maintenance schedules to avoid frequent equipment breakdown.

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION (cont) c)Improve Ship turn round time and avoid ship delays in port. d)Enhance fast cargo clearance / documentation processes through all Key players e.g. Tanzania Revenue Authority, TISCAN, Tanzania Ports Authority, TICTS, Shipping Agents, Clearing and Forwarding Agents, and Government Institutions.

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION (cont) e)Encourage port operators to acquire more land or space for storing containers within and outside the port f)Encourage establishment and operation of Inland Container Depots (ICDs) in the country. Presently in Dar es Salaam there are six licenced Inland Container Depots. More applications for establishment of ICDs are under process through Tanzania Revenue Authority

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION (cont) g)Fines or penalties be imposed for delay in cargo clearance from the port. h)Urgent improvement of services on railway and road transport for fast cargo off take from the port. i)Port operators to increase cargo/containers deliveries to consignees or their appointed agents

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION (cont) j)Having in place professional, efficient and reliable Clearing and Forwarding Agents in cargo clearance processes. k)The need to continue educating Cargo Importers on the urgent clearance of their cargo upon arrival in port. l)Carrying out more Cargo Auctions by Tanzania Revenue Authority on those cargo which stayed more than 21 days in port.

MEASURES TAKEN BY SUMATRA IN REDUCING PORT CONGESTION (cont) m)Encourage PUBLIC PRIVATE PARTNERSHIP in building new Container Terminals in the country. Tanzania Ports Authority is currently planning to build a new Container Terminal at Dar –es- Salaam port. The construction of this Container Terminal is expect to take 4 years up to 5 years from now. Tanzania Ports Authority is also planning to build new ports at BAGAMOYO, TANGA, and MTWARA

CONCLUSION SUMATRA as a regulatory body continue to play an advisory and facilitation role to Key Stakeholders in Port and Shipping services in reducing port congestion in Dar-es-Salaam port.
