M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union INSTITUTIONAL FRAMEWORK Chapter 14: Transport policy Chapter 14: TRANSPORT POLICY  Ministry of Transport and Maritime Affairs within its competence in the field of maritime affairs is responsible for adoption and implementation of maritime policy of Montenegro and adoption of national strategies for various maritime fields. The Ministry ensures proper implementation of international maritime instruments and agreements, adopts bylaws in accordance with the respective Laws and performs other activities in accordance within its authority.  Maritime Safety Department is under the Ministry and is responsible for the following:  Maritime Telecommunications  Aids to Navigation  Technical Inspectorate  Yacht Register  Maritime Search and Rescue, and  Prevention of Marine Pollution from Ships

M O N T E N E G R O Negotiating Team for the Accession of Montenegro to the European Union LEGAL FRAMEWORK Ship source pollution Directive 2005/35/EC on ship-source pollution and on the introduction of penalties for infringements (not transposed) -in the part regarding application of penalties to any person who causes or contributes to marine pollution – our legislation only applies penalties to ship owner or the master of the ship; - in the part regarding reporting to the Commission by competent authority on the application of this Directive every three years and describing the development of case-law and the possibility of creating a public database. Directive 2009/123/EC amending Directive 2005/35/EC (not transposed) Law on Prevention of Marine Pollution from Sea-going Objects, 2011 (Chapter XV – Penalties for Infringements) in accordance with international instruments.
