14 YouthBuild Regulations – An Overview Commercial Building Projects  Authorizes participation in commercial construction –Projects should directly involve the construction of affordable housing for low-income and/or homeless families and individuals

15 YouthBuild Regulations – An Overview Davis-Bacon Act  YouthBuild participants subject to Davis-Bacon Act Labor Standards –Prevailing wage requirement applies to hours spent on work site  Employment and Training Administration (ETA) will not offer further guidance  Wage and Hour Division (WHD) provides compliance details:

16 YouthBuild Regulations – An Overview YB-TAP  Not mentioned in the final rule –Standards to create pathways to registered apprenticeship established –Unintended consequences arose that became a concern for YouthBuild programs –DOL will no longer approve programs as “trainee” programs

17 YouthBuild Regulations – An Overview Program Income  Proceeds from YouthBuild construction and rehabilitation is NOT considered income –Encouraged to reinvest income (e.g. purchase land and buildings, sustainability, etc.)  Rental revenue IS considered program income –Can be used for allowable costs

18 YouthBuild Regulations – An Overview Leverage and Match Funds  Cost-sharing and match requirements detailed in grant agreement  Value of construction materials is an allowable cost for required non-federal share or match

19 YouthBuild Regulations – An Overview Leverage and Match Funds  Value of land acquired for YouthBuild program IS NOT an allowed match or cost- sharing  Value of building acquired for YouthBuild program IS an allowable match –Purchase cost is solely used for training –Allowable amount determined by proportionate share of purchase price related to direct training activities

20 YouthBuild Regulations – An Overview Covenant Clause  Rent or sell to low-income or homeless individuals and families for a period of at least ten years  Ensure owners record a restrictive covenant when an occupancy permit is issued  Inform buyers all residential housing units constructed/rehabilitated using funds in the 10-year period are subject to restrictions (section of the Final Rule)

21 YouthBuild Regulations – An Overview Allowable Costs  Post-secondary education services and activities (e.g. tutoring, study skills training)  Dropout prevention activities  Paid/unpaid work experiences  Alternative secondary school services  Counseling and referral for drug and alcohol abuse  Personal protection equipment

22 YouthBuild Regulations – An Overview Alternative School and Sequential Service Strategy  Alternative School Designation –Offer high school diploma and GED and be authorized by an appropriate entity  Sequential Service Strategy –Develop educational and occupational skills training plan –Be recognized by an authorizing entity –Award a high school diploma, GED, or both –Be affiliated with a YouthBuild program
