 Review the information required for the Proof of Necessity on PSC’s and MOA’s filed with the LRC Government Contract Review Committee 3

4

A form required to accompany PSC’s and MOA’s pursuant to KRS 45A.695(2) 5

 Need for the service  Unavailability of state personnel  Projected Cost & Source of Funds  Length of the contract  Payment information, in detail  For MOA’s, Reason for exchanging Resources or Responsibilities 6

Such other information as the committee deems appropriate 7

8

 Conduct investigations of licensed and unlicensed alcohol and drug counselors. Will interview witnesses, inspect court records and documents. Submit investigative reports to the board and its subcommittees. Compile case files, prepare testimony for hearings and interpret Alcohol and Drug Counselor law and regulations. *  *Good description or is it too much information? Could it be condensed & still convey the information? 9

 The goal of this project is to implement best management practices for failing septic systems, proper animal waste disposal, yard waste disposal, fertilizer applications and streamside wetlands 10

Provide legal counsel for 16-CI Rocky Balboa vs Apollo Creed filed in Franklin County Circuit Court. 11

 Quarterly project progress reports will be submitted and the Division of Water may conduct follow-up visits with the vendor.  Work will be monitored by the Branch Manager and Division Director. Staff will provide clinical oversight and review performance and compliance. 12

13

14

15  $56.25 per hour for 90 hours  13 $400 per session  $125/hr Partners, $90/hr Associate/ $40/hr Paralegal

16 BUDGET Salaries$75,000 Benefits 7,500 Travel 2,000 Total $84,500

17  Upon completion of scheduled Milestones  Lump sum upon submittal of approved invoice  Payment will be made on a reimbursement basis when funds are requested by the recipient and appropriate documentation is provided.

18

 Complexity and magnitude of the legal issues at hand require outside counsel  Matching Grant Program with local unit of government  No agency staff have the necessary skills to perform these specialized services. 19

In-house methods were not considered. Although the Department employs four attorney/trainers, these employees are teaching various ongoing classes to the Department’s law enforcement and law enforcement telecommunication students on a permanent, full- time basis. Instructors from other areas in the Department are not qualified in this field since the major requirement for Moot Court instructor is to be licensed to practice law in the Commonwealth of Kentucky. Additionally, the Moot Court instruction is one class out of an entire curriculum of law enforcement training offered at the Department and the hiring of permanent, full-time staff for one class would not be cost effective. * * This is a very good description but it is MUCH too long ! 20

 Bruce WayneGotham City, NJ Clark KentSmallville, KS Peter ParkerForest Hills, NY  There were no other respondents to RFP This vendor met all requirements and was awarded the contract. 21

 MOA with a Governmental Entity  MOA with a 501(c)3 non-profit  MOA with a state University with the expertise and resources required to provide the needed service. 22

 EV *0000 An RFP (758 16*9999) was placed on the Commonwealth's website. The vendor submitted the highest evaluated proposal and was awarded the contract.  Federal grant funds were advertised, vendor’s application was reviewed and ranked by a selection committee and approved for funding. 23

 Vendor is a 501(c)3 non-profit with ability and resources to perform required service efficiently and effectively.  MOA to distribute funds to entities named in KRS 11:111  MOA with state university uniquely qualified to perform the required service. Other state universities were considered but none had sufficient resources. 24

 DO NOT complete a field with N/A  Keep it BRIEF  Complete ALL required fields  ASK !! 25
