Ignorance of the Law is no excuse! ALL work, digital or otherwise, created and owned by others should have proper citations and permissions. (Note: Attribution via citation DOES NOT release you from the responsibility of getting permission to use copyrighted material!) But I cited it…

The Legal-ese Some exceptions to getting express owner permission are covered by Fair Use in Copyright Act Section 107 – the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. – In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include—the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; – the nature of the copyrighted work; the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and the effect of the use upon the potential market for or value of the copyrighted work. Sure! When you use an image—especially on a website, you need to consider: #1: Do you understand the term fair use? #2: Why are you using the image? #3: Have you transformed the image? #4: How much of the image are you using? #5: Are you willing to risk your site being taken down, getting a cease and desist/bill/DMCA or being sued? (Hawkins, n.d.)

The Fly in the Ointment (or the parmesan…) (McCall, 2009) “While invaluable to both the scholar and the pitchman, it should be noted that fair use is not a right but a defense (emphasis is mine) to copyright infringement. As such, it should be looked upon as a privilege, and not a right. The central point is that certain fair use decisions involve risk.“ (Fair Use, n.d.)

Key Points to Remember “Images may be downloaded for student projects and teacher lessons;” however, uploading afterwards requires permission. There are numerous sites providing images with public domain or creative commons licensing. Your media specialist is here to help.
