Areas of Concern Rights of Entry  Total outstanding ROEs have decreased from 120 to 98 since January 2016  6 ROEs requiring involvement from the General Counsel’s Office and Land Unit  Per the guidance of the Commissioners, WSSC is continuing the policy to contact local County Governments for assistance with securing difficult ROEs prior to implementing condemnation  To date, WSSC sent letters on 10 ROEs 10

Areas of Concern National Park Service (NPS)  WSSC continues to incur delays in acquiring NPS permits.  Moving forward  WSSC and NPS had a kick off meeting for Oxon Run on February 24, 2016  The Broad Creek Special Use permit was submitted to NPS on April 11, We are awaiting a response on moving forward with construction on the three (3) Broad Creek sites.  WSSC will move forward with an EIS for the Greenbelt Park site per NPS request. 12

Areas of Concern Consent Decree Extension  WSSC GCO has negotiated a Second Amendment to the 2005 Consent Decree with U.S. Environmental Protection Agency (EPA), U.S. Department of Justice (DOJ), and Maryland Department of the Environment (MDE) that extends completion deadlines depending on circumstances  Second Amendment was approved by parties and lodged with US District Court for approval on November 30, 2015  During public comment period, Citizen Groups requested notification of basin projects as they proceed; GCO has negotiated process for notification with the parties  DOJ expected to file Motion to Approve Second Amendment with US District Court in early May, approval hearing date to be determined by the Court 14
