Ohio Aviation Association Airspace Protection Ohio Airports Conference April 12 and

Ohio Aviation Association Airport Hazard DEFINITION “Airport hazard” means any structure or object of natural growth or use of land within an airport hazard area that obstructs the air space required for the flight of aircraft…

Ohio Aviation Association Airspace Protection  Objects, both natural and manmade, that penetrate the airspace  Blinding Lights  Radio Interference  Extensive Smoke PURPOSE The purpose of Airspace Protection is to prohibit airport hazards near public use airports. Such hazards include:

Ohio Aviation Association Airspace Protection  Federal – FAA Form 7460  State – Ohio Airport Protection Act  Local – Airspace Zoning Roles Different levels of government perform different roles in airspace protection:

Ohio Aviation Association Airspace Protection - Local Zoning BACKGROUND  County Airport Program, c. 1970, made zoning a prerequisite for receiving a grant  ORC Chapter 4563 (Airspace Zoning) Most publicly owned airports have zoning Originally slightly different From FAA Part 77 Surfaces Airport Zoning Board (in most cases, the County Commissioners) Airspace Zoning Board of Appeals $100/day penalty

Ohio Aviation Association Airports That Have Airspace Zoning 98 publicly owned GA airports in Ohio 78 publicly owned GA airports have Zoning Laws on file with the Office of Aviation Refer to handout for a list of airports with zoning on file If an airport does not have zoning on file at Office of Aviation, it might still have zoning – check with your county

Ohio Aviation Association To Obtain a Copy of Your Zoning Call the Office of Aviation: – Dave Dennis, – Mark Justice, – John Milling, Check with your county government

Ohio Aviation Association Airspace Zoning – Original Shape OLD AIRSPACE HAZARD ZONING AREA

Ohio Aviation Association Local Zoning PROBLEMS WITH THE OLD AIRSPACE ZONING PROCESS  40+ years of turnover and retirement  Lack of administrative procedures  Lack of local knowledge  Did not conform with F.A.R. Part 77

Ohio Aviation Association Local Zoning RESULTS AND RESPONSE  Objects have been constructed that are obstructions, resulting in: Displaced runway thresholds (shortened runways) Extensive cost to remove obstructions Safety issues  Solution: Ohio Airport Protection Act (ORC Chapter 4561) Adopts FAR Part 77 dimensions for ODOT and for local zoning ODOT provides statewide review

Ohio Aviation Association Local Zoning PART 77 IMAGINARY SURFACES

Ohio Aviation Association Airspace Protection - Federal CURRENT PROCESS - FAA  FAA Form 7460, “Notice of Proposed Construction or Alteration,” must be filed for any proposed object that penetrates the 100:1 slope from the runway  File online at: oeaaa.faa.gov  FAA cannot stop construction, but can require displaced threshold or relocated runways at the affected airport  Form 7460 provides information to ODOT - a critical step in the process

Ohio Aviation Association Airspace Protection – State CURRENT PROCESS - ODOT Ohio Airport Protection Act (ORC Chapter 4561, 1996):  ODOT must receive the Form 7460 information to determine whether a permit is needed  When filing the Form 7460 online, building proponents should print the completed form to a.pdf file and it to John Milling:  A hard copy can also be sent to John at the Office of Aviation

Ohio Aviation Association Airspace Protection - State CURRENT PROCESS – ODOT (cont.)  If necessary, ODOT works with proponent to modify location and/or height of the proposed construction  ORC 4561 also mandates that existing airport zoning boards adopt revisions so that local airspace zoning conforms with FAR Part 77

Ohio Aviation Association Airspace Protection - Local CURRENT PROCESS - LOCAL  Counties should add administrative procedures to enforce existing zoning  Local Building and Zoning Departments should be aware of Part 77 Filing Criteria, and make sure that building proponents: Are also aware of the filing criteria File Form 7460 online when appropriate a copy to ODOT (John Milling)  Counties should update existing zoning to conform with Part 77

Ohio Aviation Association Airspace Protection - Summary Ohio Aiation Association Coordination between Local, State and Federal jurisdictions will maximize airspace protection.
