CRIMINAL VS CIVIL ACTIONS Fraud may be prosecuted criminally or civilly. Criminal cases are brought forth by the government through the criminal justice system. Civil cases by a plaintiff. Primary difference between systems is the potential remedy for the victim: Civil process is monetary damages Criminal justice results in fines, community service, probation, incarceration, and censure

COMPARING RIGHTS The Fourth Amendment prohibits unreasonable searches and seizures The Fifth Amendment provides that a person cannot be compelled to provide incriminating information against himself in a criminal case The Sixth Amendment provides that an individual has the right to an attorney to defend himself and the right to confront witnesses against him The Fourteenth Amendment entitles a person to due process of law and equal protections under the law Reveal evidence of work-related misconduct and be helpful Rights are very limited; provide information or be terminated. The document must not have been forged. 2. Original documents are preferable. 3. The document must not be hearsay or objectionable. 4. The document needs to be authenticated. 5.
