WIPO Patent Search

DO I NEED A PATENT SEARCH ? A patent search is a good idea but it costs money upfront. Deciding whether to spend the money on a patent search is a difficult decision to make. A good search can turn up prior inventions that could potentially bar an inventor from obtaining a patent. Additionally, a good search will predict the objections that the patent office might raise against patentability and give you extra time to consider a proper response to an office action such as a rejection. If you are trying to form a new company around your invention, you need to be aware of all possible problems associated with your invention. In this case, in my opinion, it is well worth the added expense for the patent search to give yourself a "heads up" on your invention.

Process of Patent grant- The process of obtaining the grant of a patent begins with the preparation of a specification describing the invention. That specification is filed at a patent office for examination and ultimately a patent for the invention described in the application is either granted or refused. What is IP( Intellectual Property) ? IP is the intangible asset of human knowledge, ideas or innovations expressed in any form - literature, music, products, services and more.

About WIPO- WIPO (World Intellectual Property Organization) is a wing of the United Nations for developing international intellectual property system. Its headquarters is in Geneva of Switzerland. Patent Co-operation Treaty (PCT) is a sister treaty of the Paris Convention administered by the World Intellectual Property Organisation (WIPO). The PCT system facilitates filing of patent applications under a single umbrella and provides for simplified procedure for the search and examination of such applications. This allows a resident or national of a PCT member state to obtain the effect of patent filings in any or all of the PCT countries and to defer the bulk of filing costs usually due on filing.

WIPO is responsible for: Receiving and storing all application documents; Performing a formality examination; Publishing the international application on WIPO’s online database PATENTSCOPE; Publishing data about the PCT application as prescribed in the Treaty and Regulations; Translating various portions of the PCT application and certain associated documents into English and/or French, where necessary; Communicating documents to Offices and third parties; Providing legal advice on request to Offices and users.
