U.S.A. Constitution

An Outline of the Constitution Sets out the basic principles Fairly brief document. (compared to others) Organized into eight sections: the Preamble and seven articles.

Articles of the Constitution

The Six Basic Principles 1.Popular Sovereignty - people are the source of any and all government power, and government can exist only with the consent of the governed. 2.Limited Government - government is restricted in what it can do, and each individual has rights that cannot be taken away.

6 Basic Principles Continued 3. Separation of powers - the executive, legislative, and judicial branches of government are 3 independent and coequal branches of government. 4. Checks and balances - system that allows the 3 branches to check, or restrain, the actions of one another.

6 Basic Principles Continued 5. Judicial Review - power of a court to determine the constitutionality of a governmental action. 6. Federalism - system of government where the power is divided between a central government and several local governments.

Powers in the Constitution Enumerated Powers – powers directly written in the Constitution (Art. 1 sect. 8 – congress)  Examples: collect taxes, declare war Implied Powers – powers not directly written in the Const., but interpreted/assumed  Example: congress has power to regulate commerce (enumerated), congress thusly can tax interstate commerce (implied)

Other important Constitution Items Father of the Constitution was –James Madison The section of the constitution that is responsive to the needs of a changing nation are the Amendments. The Supreme Court has the final authority on the Constitution.

Ratifying the Constitution Federalists – urged ratification, strong government needed to solve Nation’s problems. Anti-Federalists-felt this took power away from the states and lacked a Bill of Rights New National Government launched in 1789 George Washington took office as President
