Commercial Requirements  Guidelines Deadline of clarification of queries; 14 March 2014 The tender shall be submitted as an original hard copy, plus 1 copy (identical to the original), and x1 soft copy in CD / USB containing the prices only in both Pdf and excel format (See Price Schedule). The soft copy is not a substitute for hardcopy which must still be provided. Failure to adhere to this requirements will render tenderer non-responsive and the tender that does not meet the requirements will be disqualified. The proposal must be well labelled and each section must contain its specific returnable requirements and must be submitted in its own folder. i.e The Original File will have the following high level folders: o Technical o Quality o SHE o Commercial o Financial (hard copies of prices and financial statement ) NB: prices on hard copies must be identical to the ones on the CD /USB.

GENERAL Zero harm is one of ESKOM values. It is the intent of the business to ensure that all employees go home to their families the same way they came to work. This can be achieved through an effective OHS Management System. 13

SOURCES OF SHE REQUIREMENTS Constitution of the Republic of South Africa (No 108 of 1996), Section 24(a) “Environmental Rights Statutes: COIDA, OHSA, NEMA etc. Eskom Requirements: SHE Spec, SHEQ Policy (32-727), Life Saving Rules ( ), Substance Abuse Policy (32-37), Vehicle and Driver Safety Management procedure ( ) and Incident Management procedure (32-95) 14

15 SHE Evaluation Returnable : OHS The following document must be submit for SHE Evaluation: 1. SHE Management system SHE Plan aligned to the Project’s SHE Specification (Form 74) SHE policy (adequate & signed by the Company’s CEO) Proposed Sufficient SHE Budget Breakdown supporting the SHE Plan Substance Abuse Policy and Programme (Procedure) Baseline Risk Assessment & SHE Method Statements (on Medium &High Risks) Company Organogram reflecting the project structure incl. workforce size. CV’s & Competency Proof of key Personnel. Incident management Procedure ( reporting and managing incident process) 15

SHE Evaluations Returnable: OHS 2. Company’s Past SHE Performance: Records for the past two years (First Aids, Medicals, fatalities & LTI). Records of Department of Labour / Department of Mineral Resources reportable incidents Any past SHE achievements. 3.Occupational Health and Wellness Medical Surveillance procedure (pre, periodic & exit examinations) Valid Letter of good standing ( proof of registration with Workman’s Compensation) 16
