Pre-Proposal Conference SOLICITATION OVERVIEW  This procurement is a “full and open/unrestricted” competition.  A public bid opening will not occur. This is a request for proposals and not a sealed bid.  Please hold all questions until the question and answer portion of the conference. At that time stand up, identify yourself and the company you are representing. 9

Pre-Proposal Conference  This is a design-bid-build construction project. Source selection will be made based on “best value” to the Government under FAR 15. Pre-Proposal Conference  Cost Proposal will be evaluated on the basis of its realism and acceptability to the Government. NOTE: Provide your best technical and cost proposals for the initial submission because VA may award without discussion. 14

Pre-Proposal Conference REVIEW ALL CLAUSES AND PROVISIONS  Offerors are cautioned that their offers may be considered non-responsive if they include any qualifications, including but not limited to price escalation reservations.  On Line Representations and Certifications: application, ORCA website complete online Reps and Certifications prior to proposal due date.  Complete Central Contractor Registration process if you have not already done so. Pre-Proposal Conference  Buy American Act Clause FAR and 12: Carefully review this clause. Everything that is installed or approved on a submittal basis is in accordance with the “Buy American Act”  Equal Opportunity: The contractor shall not discriminate against any employee or applicant for employment because of race, color, religion, sex, or national origin.  Federal, State, and Local Tax: The contractor is responsible for determining what taxes are applicable among the jurisdictions. 17

Pre-Proposal Conference  Bonds: Bid Bond, Performance Bond and Payment Bond are all required.  Insurance: Before commencing work under this contract, the contractor shall provide insurance certificate.  Builder’s Risk Insurance is not required by the VA.  Licenses/Permits: Contractor is fully responsible for any and all required licenses and permits to complete this project.  Commence work within 10 days of the Notice to Proceed. 18

Pre-Proposal Conference  Performance of Work by Contractor FAR : Performance of work by the contractor is at least 15%. See VAAR Clause for failure or refusal to meet the 15% performance of work. There is a 15% contract price reduction if performance less than 15%.  Davis Bacon Labor Standards in regards to wage rates apply. Conformance to the Davis Bacon Act is required. To add class of laborers or mechanics not listed requires contractor to submit proposal to the contracting officer for review and approval. Non compliance will be referred to the Department of Labor. 19

Pre-Proposal Conference  Value Engineering: Contractors are encouraged to develop, prepare, and submit VE change proposals voluntarily. Contractor shall share any instant contract savings if VE accepted. Submit separate from cost proposal.  VA Changes Clause: Please review carefully. VAAR Contract Changes Clause (Unique and Specific to VA )  Contractor Performance is monitored by the Resident Engineer Staff 20

Pre-Proposal Conference  Superintendence by the Contractor: Competent superintendent who is satisfactory to the contracting officer and has authority to act for the contractor.  All employees of general contractor or subcontractors SHALL have the 10-hour OSHA certified Construction safety course and /or other relevant competency training.  Personal Identity Verification of Contractor Personnel under FAR ID Cards may require Special Agreement Check (SAC) adjudication and background investigation requirement. 21

Pre-Proposal Conference  Employment Eligibility Verification under FAR requires contractor to enroll and use E-Verify to verify employment eligibility of employees and new hires.  Partnering is voluntary but highly encouraged. Cost will be split between contractor and government. The goal is to build professional work relationships geared toward successful project completion by promoting mutual benefits. 22
