Final Restated Agreement Ship’s Store – Contingent Right’s of City to lease the ship store on a temporary basis (which means the period of time during which the Developer does not intend to operate the ship store), at a rent of $10.00 per month. Community Development Department DEVELOPMENT AGREEMENT SUMMARY Current Agreement 209 unit resort condominium hotel. 47,000 sq. feet of accessory resort hotel uses including but not limited to ballrooms, restaurant, fitness center, conference/meeting space, harbor master/ships store, parking garage, pools, etc. 169 – resort condominium units in three buildings Maintain the existing 84-slip marina to provide slips for resort guests, private members and members of the public. Construct parking garage, surface parking, pools, trails, and other similar amenities. Administrative Deviations: Planning Manager may administratively approve deviations up to 10% of the site design criteria, deviations of greater than 10% may be approved by the PLDRB. All construction on the site to be completed within five (5) years of the execution date of the Agreement Extension of the 5 year time period in increments of 2 years each shall granted by the Development Services Director where circumstances beyond the reasonable control of the Developer delay completion of the project and so long as the Developer is making a good faith effort to complete the project. Restated Agreement 209 unit resort condominium hotel and/or hotel with same use entitlements as previously approved. 97 resort condominium units in 3 or 4 buildings. Development flexibility incorporated to provide for a decrease in the number of condominium units and increase the number of hotel units. If the unconstructed 8 story resort condominium building is converted into two buildings, the height of the structures is limited to 6 stories. Accelerates the construction of the Resort Hotel. Ensures Intracoastal walkway will remain open to the general public via open interconnectivity through St. Joe Walkway. Administrative Deviations: Planning Manager may administratively approve deviations up to 10% of the site design criteria, deviations of greater than 10% may be approved by the PLDRB. Construction on the site shall commence within five (5) years of the execution date of the Agreement. Extensions of this time period, in increments of 2 years each, shall be granted by the Land Use Administrator when it concludes that (i) circumstances beyond the reasonable control of the Developer delayed the satisfaction of, or prevented the Developer from satisfying, those conditions and (ii) the Developer is making a good faith effort to satisfy such conditions.
