NO NET LOSS of PUBLIC HUNTING LANDS in FLORIDA June 2008 Update

New Legislation in 2006: No Net Loss of Hunting Lands House Bill 265; Senate Bill 430 Effective June 7, 2006; Section , Florida Statutes Overview and Clarification/Interpretation Summary of Reports

Overview , F.S. Subsection (1): Definitions Commission (FWC): -Fish and Wildlife Conservation Commission Hunting: - lawful (or attempted) pursuit, trapping, shooting, capture, collection, or killing of wildlife. Commission-managed lands: -lands owned by FWC; -lands owned by the state where FWC has management authority; -privately-owned lands leased or managed by FWC.

Clarification Points: “Commission-managed lands”: -to include all areas established and regulated for public hunting under FWC rules that are owned by the state, agencies of the state, or private landowners. -excluding all federally-owned lands (i.e. National Forests, National Preserves, Federal Military Installations, and National Wildlife Refuges). Wildlife Management Areas (WMAs), Wildlife and Environmental Areas ( -acres opened to compensate for closures of existing land pursuant to subsection (4);

Clarification Points: million acres of “Commission- managed” lands including: million acres owned by the State of Florida and; -177,567 acres privately owned million acres of Federally-owned lands. Acreage of Lands in Florida’s WMA system as of June 30, 2007:

Overview , F.S. Subsection (2): Commission-managed lands shall be open for hunting except as limited: - for public safety; -for fish or wildlife management; -for homeland security; - or as otherwise limited by law.

Overview , F.S. Subsection (3): In exercising authority under the Constitution and statutes, the FWC shall: - exercise authority consistent with subsection (2); - in a manner that supports, promotes, and enhances hunting opportunities; -to the extent authorized by state law.

Overview , F.S. Subsection (4): FWC decisions and actions shall not result in any net loss of acreage available for hunting on commission-managed lands that exist on effective date (June 7, 2006). FWC shall expeditiously find replacement acreage to compensate for closures of any existing hunting land.

Clarification Point: How do we determine a “baseline” acreage to measure a net loss of hunting lands? -This would be the acreage of “Commission- managed” lands available for hunting that existed on June 7, 2006 (3.31 million acres). -This would be the threshold point where the requirement for finding “replacement” acreage would kick in. -Existing “baseline” acres are those that were “available” or open for hunting under FWC rules during the 2005/2006 hunting season.

Overview , F.S. Subsection (4) continued: Replacement lands shall, to the greatest extent possible: -be located within the same FWC administrative region -be consistent with the hunting discipline that was allowed on the closed land.

Overview , F.S. Subsection (5): Any state agency or water management district (WMD): -that owns or manages lands; -shall assist, coordinate, and cooperate with FWC to allow hunting on such lands; -if determined by FWC to be suitable for hunting;

Clarification Points: Primary criteria for determining lands that are suitable for public hunting: - Compatible with established purposes for acquisition/management and other public uses; - Have concurrence of landowner or lead managing agency; -Have adequate presence of game species for sustainable hunting; -Large enough to accommodate a minimum level of public hunting; -Adequate staff and funding available to manage hunts.

Overview , F.S. Subsection (5) continued: To ensure no net loss of land acreage available for hunting, state agencies and WMDs shall: -cooperate with FWC to open new, additional hunting lands to replace lost hunting acreage; -state parks excluded except as necessary for wildlife control or management as determined by DEP.

Overview , F.S. Subsection (6): By October 1 of each year, FWC Executive Director shall report regarding commission-managed lands: -acres closed to hunting during the previous fiscal year (July – June); -acres opened to compensate for closures of existing land pursuant to subsection (4).

FWC Report for Fiscal Year Acres removed from the WMA system (July 2006 – June 2007) 12,069 total acres removed 31,293 acres were added to the WMA system above the 2006 baseline, more than compensating for lost acreage. Note: During the current year, 21,048 acres were removed from the WMA system and 34,645 acres were added (open for the hunting season).

Overview , F.S. Provision (7): By October 1 of each year, any state agency or WMD that owns or manages lands shall submit: -a list of properties that were open for hunting during the previous fiscal year (July – June); -a list of properties that were not open for hunting during the previous fiscal year; -acreage and county for each property; -excluding right-of-way lands and parcels under 50 acres.

FWC Report for Fiscal Year Summary of Properties Open for Public Hunting This includes all state, private, and federal lands established as Wildlife Management Areas, Wildlife and Environmental Areas, Public Use Areas, Public Waterfowl Areas, Public Small Game Hunting Areas. 151 Properties -- 5,660,603 acres.

FWC Report for Fiscal Year Summary of Properties Not Open for Hunting Includes only those properties where FWC is lead manager or landowner. This includes 19 Critical Wildlife Areas and 13 Wildlife and Environmental Areas. 32 Properties -- 25,572 acres 99% of total acreage comprising Commission managed lands are open for public hunting.

Fiscal Year Reports for Other State Agencies The Division of Forestry reported 936,506 acres open for public hunting and 74,596 acres not open (92.2% open). The South Florida WMD reported 683,411 acres open for public hunting and 264,831 acres not open (72.1% open).

Fiscal Year Reports for Other State Agencies The Southwest Florida WMD reported 153,417 acres open for public hunting and 158,423 acres not open (49.2% open). The Suwannee River WMD reported 96,210 acres open for public hunting and 61,547 acres not open (62% open).

Fiscal Year Reports for Other State Agencies The Northwest Florida WMD reported 204,811 acres open for public hunting and 2,097 acres not open (99% open) The St. Johns River WMD reported 366,251 acres open for public hunting and 206,906 acres not open (64% open).
