Amendments to N.J.A.C. 6A:26, Educational Facilities

N.J.A.C. 6A:26  The New Jersey Department of Education in close consultation with the New Jersey Department of Environmental Protection has developed these amendments to N.J.A.C. 6A:26 to require immediate testing for lead in the drinking water in our schools.  The U.S. Environmental Protection Agency has provided guidance for reducing lead in drinking water for schools, called the 3T’s.

Testing - Who  All Public Schools  Regular  Charter  Renaissance  Jointure Commissions  Education Services Commissions  Approved Private Schools for Students with Disabilities  State Funded Early Childhood Centers

Testing - What  All drinking water outlets  In accordance with the “Lead Sampling Plan”  Plumbing Survey Entry Flow Plumbing materials Fixtures

Testing - How  Responsible Personnel  Sampling Procedures  Eight hours undisturbed Signage  Non-disturbance of hardware Aerators, screens, filters Collecting Protocols  Certified Lab  Federal Drinking Water Act  Quality Assurance Project Plan Methods Chain of custody Data validation

Testing - When  Conduct lead sampling and analysis no later than 365 days from the effective date of the regulation.  May apply for a 365 day extension  Within six years following the initial testing and every six years thereafter.

Telling  Within 24 hours of the School District Board of Education review of results a)Test results publicly available Website b)Written notification parents/guardians and NJDOE when results exceed permissible lead action (15 ppb) c)Annual Statement of Assurance

Training The New Jersey Department of Environmental Protection in consultation with the New Jersey Department of Education will provide technical guidance to assist boards of education in complying with sampling and analysis requirements.
