Enforcement of HGV: Difficult issue for TISPOL In spite of EU legislation (Regulations) considerable differences in enforcement in the M.S. Complex: rules complex, digital tacho fraud, dealing with foreign drivers, many different documents. Few experts available, due to complexity and resources required for experts. Less resources the next years to come. Brussels 27-2-2013

What does TISPOL do at the moment? Truck and bus control operations Transport Document System (TDS) Master classes Tachoweb (expert system tacho fraud) Joining Eu working groups/expert committees Full cooperation with ECR Cooperation with Industry (IRU/ECR/TISPOL) Supporting the implementation of the cross-border enforcement Directive Supporting the implementation of the ERRU Brussels 27-2-2013

Will that do for the future? NO, Because: Brussels 27-2-2013

Less and less enforcement capacity (time) is available. No real political will in the M.S. to achieve harmonisation. There are so many ways to “escape” from the rules, that the work that is done has only a limited effect. Sometimes naive assuptions about capability of enforcement (group of wise men/new cabotage rules). Risk of demotivation of law enforcement officers. Brussels 27-2-2013

What is needed for the future? A combination of more targeted (intelligence led) enforcement and a better use of technology, so that the sparse human capacity can be used in a more clever way, leaving as much of the “dumb work” as possible for the technology. Let the officer do what the officer can do best and let the technology do what the technology can do best. Brussels 27-2-2013

Is this a completly new idea? Certainly not. Discussions about “Risk Rating systems” in the past(ERRU is an example) to select out the “black sheep”. Discussions about intelligent monitoring systems (e.g. “long distance monitioring”). Weigh-in-motion and analysis of registered data. REMOVE Project. Brussels 27-2-2013

Why do we not succeed to implement the right technologies? There is no comprehensive EU policy about use of technology for this type of law enforcement and the Member States have completely different views (e.g. UK/NL vs. Germany). The actual developments in the road transport market are the driving forces, (EU) rules lag behind, enforcement lags behind even more. This is not the right context for clever deployment of new technologies. There is no political will in the member states to deal with the issue properly. M.S. all stick to their own national legislative context. Law enforcement is also devided. Privacy discussions need to be solved(DEPET) Brussels 27-2-2013

Conclusions: The proper conditions for succesful deployment of law enforcement technolgies for HGV throughout the EU are not yet in place. These conditions are the most basic requirement for a succesful future enforcement policy on HGV. Such a policy would be based on intelligence and targeted enforcement. The approach will have to be “top-down”, meaning: first the right political and legislative conditions and then the technology itself. Much time and resources are wasted now in trying to make the approach “bottom-up”. Law enforcement will have to convince politicians that another approach is required. If it fails to do so, effective law enforcement will more and more become an illusion. Brussels 27-2-2013
