Marginalization of children by society due to lack of legal documents.

Background: Nkomazi received refugees during the Mozambique’s civil war. Many such refugees were undocumented. Due to economic reasons, people continue to migrate to SA. SA’s borders are porous. Challenge: Depart of Education insisting on children having legal documents. There is no plan to assist OVCs not having legal documents due to historical factors. Current status Many children have been accepted in the schools but have been told to produce their documents by April some by May. If unable they have been told they will have to leave. There are many children no longer attending school. Its difficult to establish these numbers. Children’s right to basic education is being violated. The right of all children to education is being violated because children without birth certificates are being excluded from schools. There is a contradiction between the Constitutional right to education for all, and the Immigration Act’s (2002), Sections 39 and 42 prohibition of providing training or instruction to undocumented migrants (‘illegal foreigners’).

Scope of the problem: In the Enhlanzeni district in 2013 & 2014, 1,300 learners wrote matric, but without legal documents such is useless. In 2014 Thembalethu recorded 600 children in and around Schoemansdal village that do not have IDs. Extrapolation of these numbers indicates a potential 5,000 children at risk of exclusion from school and work Second, exclusion from education creates vulnerable and marginal groups. Excluding long-term local residents from education on the basis of documentation is creating a group of poor and vulnerable residents, which has negative impacts on the entire community Third, these children cannot be repatriated as they do not belong to either Mozambique or Swaziland.

Our findings are: Education is a basic right. According to the Constitution, no child may legally be denied basic education or discriminated against for any reason in accessing schooling. This includes non-citizen children and children who do not have South African birth certificates. International instruments such as the University Declaration of Human Rights; the International Covenant on Economic, Social and Cultural Rights; and the Convention on the Rights of the Child set out the right to education for all children and the prohibition against discrimination of any kind. As stated in the Committee on Economic, Social and Cultural Rights "the principle of non-discrimination extends to all persons of school age residing in the territory of a State party, including non-nationals, and irrespective of their legal status."

Our findings are: Education is a public good. An entire society benefits from education for all, while an entire society feels the negative effects of excluding individuals and groups from education. Those who are excluded from education are more likely to remain unemployed and unemployable, may be more likely to turn to crime, and are therefore more likely to become a drain on the society’s formal and informal social support mechanisms. Education access is not an immigration management tool. Especially in border areas, but also elsewhere in the country, migration from other countries is an established reality. Excluding children of migrants from services such as education will not prevent them from coming to South Africa and will not induce them or their families to leave the country. It will only make them vulnerable within the country, with negative effects for the entire society.

Our recommendations: The children who have left school without certification be given their rightful documents. The state should provide assistance registering such OVCs instead of leaving to be the burden of the family. This is a societal challenge therefore schools should be able to openly communicate about the matter.
