Te Aitanga a Mahaki Claims Update Te Aitanga a Mahaki Hui a Iwi Takipu Marae 1pm, 28 May 2017

This Update will Cover: The Settlement of Historical Treaty Land Claims Whakatohea claims Housing Claim Inshore Fisheries & Marine and Coastal Area Former Te Karaka Primary School site – Proposal from Rangatira marae.

1. The Settlement of Historical Treaty Land Claims Aiming for a unified approach to the Tribunal for the resolution of Mahaki, Whanau a Kai and Ngariki claims. The settlement proposal was agreed at Tarere Marae on 5 March 2017. The proposal to be put to Te Whanau a Kai and Ngariki will be: Claimant Group 2011 Cash Proposed 2019 Cash Te Whanau a Kai $6.2m $16m to $18m plus a percentage of any increases in total compensation over $100m Ngariki Kai $2.48m $7.2m plus plus a percentage of any increases in total compensation over $100m We will also look at 8% of the Mahaki share of the Mangatu forest plus another 300 hectares of the Mangatu forest exclusively for Ngariki.

2. Whakatohea: Proposed Resolution - That Te Aitanga a Mahaki supports Te Whakatohea taking Co-Governance arrangements coupled with an Right of First Refusal throughout the Crown land managed by the Department of Conservation within the rohe asserted by Te Whakatohea on the condition that: There is an agreement between Te Whakatohea and Te Aitanga a Mahaki that guarantees that Te Aitanga a Mahaki is not prevented from joining such Co- Governance arrangements or sharing the RFR right for any land within the overlap/cross claimed areas between Te Whakatohea and Te Aitanga a Mahaki. This agreement between the two Iwi is reflected in the Te Whakatohea Deed of Settlement, Ratification booklet and Settlement legislation. Moved: John Ruru Seconded: Wirangi Pera

3. Mahaki Housing Claim Update Ruby Baty filed a housing claim against the Crown in 1993. At the Mahaki Hui a Iwi on 5 March 2017 (Tarere Marae) the Iwi agreed to support the proposal for Te Aitanga a Mahaki to acquire the HNZ homes in the rohe of Te Aitanga a Mahaki on the understanding that: There is no liability on Te Aitanga a Mahaki; Whanau in the homes would have the immediate opportunity to purchase the homes at a discounted rate: the more homes acquired, the bigger the discount. For those who wish to continue as tenants, there was the opportunity for a purchase of their house or a house on their land over a 10 year period through: Receive whanau ora support: which is about empowering the whanau to a better future; and Align with the training and economic development opportunities through Mahaki and the eventual settlement of the treaty claims.

What are we talking about What are we talking about? 700 Housing NZ homes in the rohe of Te Aitanga a Mahaki

An example of an immediate purchase One house in Te Karaka is valued at $88,000. By purchasing 700 or more houses we aim to achieve a discount of 40%. This house would then be able to be purchased by the whanau for $52,800. Alternatively, over a 10 year period, the tenant who wants to purchase that home could either: Approach a commercial bank; or A rent to own arrangement with the Iwi (which would be slightly better than the interest arrangement with a commercial bank).

4. Inshore Fisheries and Marine & Coastal Area Update We need to work through shares with Rongowhakaata and Ngati Porou This will start with a meeting between Ngati Oneone, Ngai Tawhiri (Rongowhakaata) and Te Whanau a Iwi on 25 June 2017 at Te Poho o Rawiri. The aim is to ensure an outcome that sees Rongowhakaata and Te Aitanga a Mahaki achieve the same quota that we have utilised for the past decade. This is what Bill Ruru supported on our behalf back in May 2015. Marine and Coastal Area (Foreshore and Seabed) We deliberately did not file an application as we do not agree with the process that the Crown put in place. We do not want to be in a position of conflict with our relations We will meet to discuss our customary Marine and Coastal area at Awapuni, Waiohiharore, Kaiti and Pouawa with Ngati Oneone, Ngai Tawhiri (Rongowhakaata) and Te Whanau a Iwi on 25 June 2017 at Te Poho o Rawiri.

5. Te Karaka Primary School Site We have received a proposal from Rangatira marae. They are wanting to move their marae to the Te Karaka Primary School site. The current site was devasted by Cyclone Bola. It is now flood prone. They have a strong committed whanau who behind this proposal. Some of our pakeke and our Trust Chair has raised issues of tikanga that need to be discussed. This proposal is received now and will be finalised at the next pakeke and Hui a Iwi. As the Te Aitanga a Mahaki leader negotiator I support: Strengthening our marae as per our agreed strategic plan; Building the reo, tikanga, karakia and waiata at each marae as per our strategic plan; This proposal from Rangatira marae.
