Senate Bill 11 Effective August 1, 2016 Since 1995 a CHL holder has been able to carry a concealed handgun on a university campus in a public or private driveway, street, sidewalk or walkway, parking lot, parking garage, or other parking area. Take out the “Currently” section after Aug. 1, 2016 Use the 1995 date to point out that concealed carry has been in effect in the state for over 20 years. Persons have already been around concealed carry license holders in the mall, grocery store, movie theater, etc.

TAMUS Categories (cont.) Explain that these categories have been created by TAMUS. Point out that each institutions rules may differ from ours at Texas A&M (College Station). License holders travelling to other A&M campuses or components can/should make themselves familiar with their rules prior to arrival. Mention that the following slides will show both the TAMUS …. TAMU University Rule 34.06.02.M1 - Carrying Concealed Handguns on Campus Allowed in ALL TAMUS classroom and residence facilities owned/leased and operated by institution

Classrooms & Residences No rule at any Texas A&M System member prohibits a licensed holder from carrying a concealed handgun in: Classrooms, or; Residential facilities owned and operated, or leased and operated, by the institution. Allowed in ALL TAMUS classroom and residence facilities owned/leased and operated by institution

Scientific Laboratories (TAMU) High hazard research areas and laboratories where the presence of high hazard materials or operations creates a significant risk of catastrophic harm due to a negligent discharge. Research areas and laboratories in which research subjects are high risk (e.g., binge drinkers, subjects with diagnosed psychological disorders, subjects diagnosed with Post-Traumatic Stress Disorder), or where the integrity of psychological research could be compromised A university procedure will contain a process for review and approval of locations by the president TAMU Point out the that the second bullet item is unique to TAMU. The review and approval process will be discussed in a later slide.

Campus Preschool Campus preschool, elementary and secondary school facilities in which the concealed carry of handguns is prohibited by state law. Health & Psychological Counseling (TAMU) Counseling centers where licensed practitioners receive patients and protected health information is generated (including those for faculty, staff, and students) Health care facilities where protected health information records are generated Obvious – Beutal Health Center & Student Counseling.

Collegiate & Interscholastic Sporting Events (TAMU) A license holder may not carry a handgun, on or about his person, on the premises where a collegiate sporting event is taking place (unless the license holder is a participant in the event and a handgun is used in the event) so long as effective notice is given under Section 30.06, Texas Penal Code Largest venue is Kyle Field

Assigned Offices (TAMU) Assigned employee offices for which: The employee has demonstrated that the carrying of a concealed handgun by a license holder in the office presents a significant risk of substantial harm due to a negligent discharge of the handgun, and; The president/CEO has approved the employee’s request that the office be designated as an area where licensed concealed carry of a handgun is not permitted

Other Campus Premises Texas A&M University Any campus premises leased by the university to a third party, if the third party determines to prohibit the concealed carry of handguns on the premises and provides effective notice pursuant to Section 30.06, Penal Code All Faiths Chapel Clinical facilities of the School of Law Marine vessels, owned or operated by TAMUG

Other Campus Premises Texas A&M University Premises approved by the President as areas on which licensed carry is prohibited are specific to the room or rooms approved by the President. No individual is authorized to expand that area to encompass adjacent hallways, common areas, etc. without the review and approval of the President.

Federal Law Prohibitions A license holder is responsible for complying with the applicable federal law prohibitions. This includes, but is not limited to, the following facilities: George Bush Presidential Library Nuclear research reactors Multi-Program Research and Education Facility Northgate Post Office Polling places (MSC) Removed: Oral notification Written notification Sample language provided in the law

Vehicles A license holder may carry a concealed handgun on or about the license holder’s person while in a university vehicle, unless prohibited by state or federal law, or campus rule. Removed: Oral notification Written notification Sample language provided in the law

Securing Weapons Employees who are license holders are permitted to store a handgun in their office space so long as the gun is secured in a locked drawer or compartment. All license holders must secure their handgun when it is not on or about their person. Removed: Oral notification Written notification Sample language provided in the law

Securing Weapons Any resident of campus housing who is a license holder and wants to store a handgun in his/her room must securely store it in a safe that is purchased or rented from the Department of Residence Life. Penalty If a License To Carry holder carries a concealed weapon into a facility or area prohibited by TAMU rules or remains after receiving effective notice: Class A Misdemeanor Up to one year days in jail; Fine of up to $4,000, or; Both jail and fine

Advisory Committee on Campus Carry Implementation Guidelines for posting approved signage; Processes for requesting and reviewing requests for presidential approval of areas where licensed carry of a handgun will be prohibited as per section 6.C.2 of the rule. Provide regular updates to the president and, subsequently, the campus community regarding implementation of campus carry rules. Develop a program to periodically review and update the list of premises on campus where licensed carry of a handgun is prohibited.

Frequently Asked Questions How many people have a concealed handgun license (CHL) in Texas? As of December 31, 2015, the Texas Department of Public Safety reported that there were 937,419 active concealed handgun license holders. The population of Texas was 27.46 million in 2015; 3.4% held a CHL.

Frequently Asked Questions Is a CHL holder required to tell someone other than a peace officer or magistrate if they have a CHL? No. A handgun license holder is not required to disclose he has a license to anyone except a magistrate or peace officer. A person engaged in lawful activity is not required to provide information to any person, including a university official, about their personal choices, beliefs, or practices.

Frequently Asked Questions Will the new open carry law allow license holders to openly carry a handgun on campus? NO. HB 910, the open carry law (effective January 1, 2016), provides a handgun license holder cannot carry a partially or wholly visible handgun in plain view of another person on the premises [building] of a university, or any driveway, street, or parking area of a university.

Frequently Asked Questions What do I do if I see someone with a handgun on campus? The safest course of action is to call the Texas A&M University Police Department (UPD) by dialing 911. UPD will respond and make contact with the individual to determine if that person is an authorized license holder and is legitimately carrying a firearm.
